About modification of the Procedure for preferential mortgage lending of internally displaced persons at the expense of the means of grant provided by Credit institute for recovery (KfW)

The Cabinet of Ministers of Ukraine decides:

1. Bring in the Procedure for preferential mortgage lending of internally displaced persons at the expense of the means of grant provided by Credit institute for recovery (KfW) approved by the resolution of the Cabinet of Ministers of Ukraine of April 28, 2021 No. 451 "Question of provision of soft mortgage loans to internally displaced persons at the expense of the means of grant provided by Credit institute for recovery (KfW)" (The Official Bulletin of Ukraine, 2021, No. 39, Art. 2326; 2024, No. 63, the Art. 3769) (further - the Procedure for crediting), the enclosed changes.

2. Determine that before implementation of the new mechanism of submission by internally displaced persons of statements for intention to obtain soft mortgage loan electronically means of the Single state web portal of electronic services (further - the Action Portal) such applications are submitted by internally displaced persons personally to regional departments of the Public specialized financial institution "State Fund of Assistance to Youth Housing Construction" in the form established by the specified organization and without documentary check of compliance of citizens to requirements, established procedure of crediting, except the requirements established in paragraphs the twelfth and sixteenth Item 11 of the Procedure for crediting.

3. To provide to the ministry of digital transformation till January 1, 2025 implementation of the new mechanism of submission by internally displaced persons of statements for intention to obtain soft mortgage loan electronically means of the Action Portal, and also information exchange of the Action Portal with electronic information system of the public specialized financial institution "State Fund of Assistance to Youth Housing Construction".

Changes which are made to the Procedure for preferential mortgage lending of internally displaced persons at the expense of the means of grant provided by Credit institute for recovery (KfW)

State Items 11 and 11-1 in the following edition:

"11. The application is submitted to financial institution by the applicant who underwent authentication with use of the integrated system of authentication, the qualified digital signature or other means of electronic identification which allow to identify the applicant's personality unambiguously.

The following data are specified in the statement:

surname, own name, middle name (in the presence) applicant and members of his family;

birth date of the applicant and members of his family;

sex of the applicant and members of his family;

series (in the presence) and passport number of the citizen of Ukraine and members of his family (in the presence);

registration number of accounting card of the taxpayer of the applicant and members of his family (except cases when the applicant and members of his family because of the religious beliefs refuse adoption of registration number of accounting card of the taxpayer and officially notified on it the relevant monitoring body and have mark in the passport) (except juvenile children);

unique number of entry in the Unified state demographic register of the applicant and members of his family (in the presence);

the region in which the applicant wishes to obtain the credit;

the number of members of the family of the applicant to whom action of Item 6 of this Procedure extends;

data on marital status of the applicant;

confirmation of the fact of capture of the applicant and members of his family on whom action of Item 6 of this Procedure, extends to accounting of internally displaced persons;

confirmation of the fact of availability of the official income of the applicant in any month from the last two quarters, information on which is available in the State register of obligatory national social insurance and/or the State register of physical persons - taxpayers or for the objective reasons is absent in the specified registers, but is confirmed with the applicant's mark about their actual availability;

confirmation of the fact of absence in property of the applicant of the residential real estate (except the residential real estate located in the territories of active fighting, the territories of active fighting in which the state electronic information resources function or the territories of Ukraine which are temporarily occupied by the Russian Federation included in the list of the territories in which are conducted fighting or temporarily occupied by the Russian Federation, the approved Minreintegration for which date of completion of fighting or temporary occupation is not determined (was conducted). In case of arrangement of the residential real estate which is in property of the applicant in such territories, the applicant puts down the corresponding mark about it in the statement);

mark about absence in property of members of the family of the applicant of the residential real estate (except the residential real estate located in the territories of active fighting, the territories of active fighting in which the state electronic information resources function or the territories of Ukraine which are temporarily occupied by the Russian Federation included in the list of the territories in which are conducted fighting or temporarily occupied by the Russian Federation, the approved Minreintegration for which date of completion of fighting or temporary occupation is not determined (was conducted));

mark about lack of the facts of obtaining by the applicant or members of his family at full age age at the expense of budgetary funds of the state support / cash compensation / the credits on favorable terms for construction (acquisition) of housing according to this Procedure and/or other conditions;

contact information of the applicant (e-mail address, phone number).

The application is signed by imposing of the qualified digital signature or the advanced digital signature based on the qualified digital signature certificate.

Action Portal software by electronic information exchange with the Single information database about internally displaced persons, the State register of obligatory national social insurance, the State register of physical persons - taxpayers, the State register of the corporeal rights to real estate, the Unified state demographic register through unified information system of the Ministry of Internal Affairs in real time carry out verification of presence of personal data of the applicant and members of his family in the relevant information bases and the state registers and their analysis.

Processing of personal data of the applicant and members of his family is performed according to the procedure, determined by the legislation on personal data protection and information security in information and communication systems.

11-1. The data specified in the statement in case of confirmation of personal data of the applicant and members of his family are transferred by electronic information exchange to electronic information system of financial institution by Action Portal software.

Data concerning statements according to which are not transferred to financial institution:

there are no personal data of the applicant and/or members of his family on whom action of Item 6 of this Procedure, in the single information database expatiates on internally displaced persons;

to the applicant for date of submission of the statement by him performed 65 years;

according to the data received from the State register of the corporeal rights to real estate, the applicant has living space in property and the applicant does not confirm the real estate arrangement fact in the territories of active fighting, the territories of active fighting in which the state electronic information resources function, or the territories of Ukraine which are temporarily occupied by the Russian Federation included in the list of the territories in which are conducted fighting or temporarily occupied by the Russian Federation, the approved Minreintegration for which date of completion of fighting or temporary occupation is not determined (was conducted);

concerning the applicant in the State register of obligatory national social insurance or the State register of physical persons - taxpayers there are no data on availability of the income for at least one month from the last two quarters, information on which is available in the state registers specified in this paragraph and the applicant does not confirm their actual availability with the corresponding mark;

the applicant does not confirm absence in property of members of the family of the applicant of the residential real estate (except the residential real estate located in the territories of active fighting, the territories of active fighting in which the state electronic information resources function or the territories of Ukraine which are temporarily occupied by the Russian Federation included in the list of the territories in which are conducted fighting or temporarily occupied by the Russian Federation, the approved Minreintegration for which date of completion of fighting or temporary occupation is not determined (was conducted));

the applicant does not confirm lack of the facts of obtaining to them or members of his family at full age age at the expense of budgetary funds of the state support / to cash compensation / the credits on favorable terms for construction (acquisition) of housing according to this Procedure and/or other conditions;

the applicant and/or members of his family are not citizens of Ukraine according to data from the Unified state demographic register.

Information that data concerning the statement are not transferred to financial institution goes to the applicant Action Portal software.

The information specified in the statement provided by Action Portal software is considered by financial institution. By results of check of compliance of the applicant to the conditions of loan granting determined by Item 8 of this Procedure the decision on inclusion or refusal in inclusion of the applicant in the register list of candidates is made, information on what is transferred to system of the portal action by electronic information exchange. The notification on adoption of the relevant decision of financial institution goes to the applicant Action Portal software.

Information on inclusion of the applicant in the register list of candidates is posted the next working day on the website of financial institution.

Electronic information exchange of the Action Portal and the information base and the state registers determined by the paragraph the eighteenth Item 11 of this Procedure is performed according to Procedure electronic (technical and information) the interaction approved by the resolution of the Cabinet of Ministers of Ukraine of September 8, 2016 No. 606 (The Official Bulletin of Ukraine, 2016, No. 73, Art. 2455; 2023, No. 11, Art. 721). The procedure for electronic information exchange of the Action Portal and electronic information system of financial institution, structure and format of the data specified in the statement, the mechanism and channels of information exchange, the procedure of interaction of information systems, accounting of information files are determined Mintsifra together with financial institution, and if technically possible - according to Procedure electronic (technical and information) the interaction approved by the resolution of the Cabinet of Ministers of Ukraine of September 8, 2016 No. 606."
