About approval of Changes in some regulatory legal acts of the Ministry of Regional Development, Construction and Housing of Ukraine

According to the paragraph the fifth Item 8 of the Section XI "Final and transitional provisions" of the Law of Ukraine "About Waste management", Item 8 of the Regulations on the Ministry of the development of communities, the territories and infrastructure of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of June 30, 2015 No. 460 (in edition of the resolution of the Cabinet of Ministers of Ukraine of December 17, 2022 to No. 1400), and for the purpose of reduction of regulatory legal acts in compliance with the legislation of Ukraine I ORDER:

1. Approve the enclosed Changes in some regulatory legal acts of the Ministry of Regional Development, Construction and Housing of Ukraine.

2. To provide to department of utilities submission of this order on state registration in the Ministry of Justice of Ukraine in accordance with the established procedure.

3. To provide to the sector of external communications promulgation of this order on the official website of the Ministry of development of communities, the territories and infrastructures of Ukraine.

4. This order becomes effective from the date of its official publication.

5. I reserve control over the implementation of this order.

Changes in some regulatory legal acts of the Ministry of Regional Development, Construction and Housing of Ukraine

1. According to the procedure of informing consumers on the intention of change of prices/rates for utilities with reasons for such need approved by the order of the Ministry of Regional Development, Construction and Housing of Ukraine of June 05, 2018 No. 130, registered in the Ministry of Justice of Ukraine on June 26, 2018 at No. 753/32205:

Item 3 of the Section I to state 1) in the following edition:

"3. In this Procedure terms are used in the values given in the Laws of Ukraine "About housing and communal services" and "About waste management";

2) in item 4 of the Section II:

in paragraph one of the word "the address with" to replace with the word "management";

state paragraph two in the following edition:

"the general size of the planned rate for service in management of household waste for the final consumer given to body authorized to install rates, the established rates separately on each transaction on management of household waste (collection, transportation, recovery and removal of household waste), and types of household waste (mixed, large-size, repair, dangerous, waste of green plantings) and their structure; expenses of the administrator of service in management of household waste (in case of its determination);";

third to exclude the paragraph.

According to the procedure of consideration by local government bodies of calculations of rates for heat energy, its production, transportation and delivery, and also calculations of rates for the utilities given for their establishment, No. approved by the order of the Ministry of Regional Development, Construction and Housing of Ukraine of September 12, 2018 239, registered in the Ministry of Justice of Ukraine on October 18, 2018 at No. 1172/32624:

1) in the Section I:

in Item 1 after the words "About Drinking Water, Drinking Water Supply and Water Disposal", "About Housing and Communal Services" to add with words ", " about waste management"";

state Item 2 in the following edition:

"2. This Procedure is applied by local government bodies in time:

considerations of calculations of rates for heat energy, its production, transportation and delivery, and also calculations of rates for utilities (delivery services of heat energy, to supply of hot water, centralized water supply, centralized water disposal, management of household waste, and also transaction of collection, transportation, recovery and removal of household waste) also extends to the subjects of managing specified in Item of 1 this Procedure;

establishment of rates for transactions on collection and transportation of the household waste offered by the winner of tender on implementation of transactions on collection and transportation of household waste in competitive offers.";

in Item 5 of the word and figures "Procedure for the forming of rates for services in the address with household waste approved by the resolution of the Cabinet of Ministers of Ukraine of July 26, 2006 No. 1010" shall be replaced with words also in figures of "Procedure for forming of the weighted average rate for service in management of household waste, and also rates for collection, transportation, recovery and removal of household waste approved by the resolution of the Cabinet of Ministers of Ukraine on September 26, 2023 No. 1031".

in paragraph one of Item 2 of the word "the address with" to replace with the word "management";

"10. In case of establishment of rates in the field of management of household waste (rate for service in management of household waste (further - service), and also rates for collection, transportation, recovery and removal of household waste (further - on management of household waste) the applicant it are in addition provided to transaction:

1) calculation of complete cost of transactions for management of household waste (the approximate form of calculation is given in appendix 33);

calculation of the general production expenses connected with implementation of transactions on management of household waste (the approximate form of calculation is given in appendix 34);

calculation of the administrative expenses connected with implementation of transactions on management of household waste (the approximate form of calculation is given in appendix 35);

calculation of the distribution costs connected with implementation of transactions on management of household waste (the approximate form of calculation is given in appendix 36);
