About approval of Rules of forming and maintaining the unified register of accounting of the facts of approach of medical incident and insured events

According to Item 1 of article 270-3 of the Code of the Republic of Kazakhstan "About health of the people and health care system" PRIKAZYVAYU:

1. Approve Rules of forming and maintaining the unified register of accounting of the facts of approach of medical incident and insured events, according to appendix to this order.

2. To provide to committee of medical and pharmaceutical control of the Ministry of Health of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Health of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order submission to Legal department of the Ministry of Health of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Health of the Republic of Kazakhstan.

4. This order becomes effective since October 23, 2024 and is subject to official publication.

Rules of forming and maintaining the unified register of accounting of the facts of approach of medical incident and insured events

Chapter 1. General provision

1. These rules of forming and maintaining the unified register of accounting of the facts of approach of medical incident and insured events (further – Rules) are developed according to Item 1 of article 270-3 of the Code of the Republic of Kazakhstan "About health of the people and health care system" (further – the Code) and determine procedure for forming and maintaining the unified register of accounting of the facts of approach of medical incident and insured events.

2. The basic concepts applied in these rules:

1) the organization of health care – the legal entity performing activities in the field of health care;

2) authorized body in the field of health care (further – authorized body) – the central executive body performing management and cross-industry coordination in the field of protection of public health of the Republic of Kazakhstan, medical and pharmaceutical science, medical and pharmaceutical education, sanitary and epidemiologic wellbeing of the population, drug circulation and medical products, qualities of rendering medical services;

Medical incident – the event connected with delivery of health care according to standards of the organization of delivery of health care and with use of technologies, the equipment and tools, caused by variation from normal functioning of organism which can do harm to life and health of the patient and also to lead 3) to the death of the patient, except as specified, provided by the administrative and penal legislation of the Republic of Kazakhstan. Medical incident is not insured event.

3. The unified register of accounting of the facts of approach of medical incident and insured events (further – the Unified register of medical incident and insured events) performs accounting and information function and allows to inform concerned parties on the current situation in the field of safety and quality of medical care, providing with data of the analysis of the facts of approach of medical incident.

4. The insured event under the agreement of joint insurance of professional responsibility of health workers admits the fact of damnification of life and to health of the patient as a result of implementation of medical activities.

5. The unified register of accounting of the facts of approach of medical incident and insured events is created, kept by the subordinated organization (further – the Organization) determined by authorized body in the field of health care.

Chapter 2. Procedure for forming and maintaining the unified register of accounting of the facts of approach of medical incident and insured events

6. The organization creates the unified register based on analysis results of the facts of approach of the medical incident and insured events held by support service of the patient and internal examination of the medical organizations (further – Service), and also the data from information platform of single insurance pool, including in itself the merging of group of companies without formation of legal entity created for the purposes of insurance of professional responsibility of health workers of the Republic of Kazakhstan.

The administrator of single insurance pool provides access to information platform.

7. The service quarterly sends the facts of approach of medical incident and insured events to the Organization for inclusion in the unified register of accounting of the facts of approach of medical incident and insured events.

8. The unified register of accounting of the facts of approach of medical incident and insured events across the Republic of Kazakhstan is created and kept in electronic format in the Kazakh and Russian languages, in forms of data of the unified register of accounting of the facts of approach of medical incident according to appendix 1 and the data of the unified register of accounting of the facts of approach of insured events according to appendix 2 to these rules.

9. Placement of the unified register of medical incident and insured events is performed on official Internet resource of the Organization with ensuring information security according to the Law of the Republic of Kazakhstan "About information access".
