Rules of registration of topology of integrated chips

These rules determine procedure for creation, submission of requests for registration of topology of integrated chips (further - the request for registration) and conducting state examination.

Chapter 1. General provisions

1. Registration of topology of integrated chips (further - topology) the Ministry of Justice of the Republic of Uzbekistan (further - the Ministry) is the compulsory provision of legal protection of the topology which was not used earlier for commercial purposes.

If use of topology for commercial purposes, according to article 8 of the Law of the Republic of Uzbekistan "About legal protection of topology of integrated chips" took place (further - the Law) the application for registration shall be submitted in time, not exceeding two years from the date of the first use.

2. The request for registration shall belong to one topology. The request for registration of topology of basic matrix crystal can include the materials relating both to topology of the most basic matrix crystal, and to topology of the custom integrated chips realized on its basis.

3. The application for registration is submitted by the author (authors), the employer or their legal successor (further - the applicant) is direct or through the authorized representative in the Ministry.

Chapter 2. Creation of the request

§1. Structure of the request for registration

4. The request for registration shall contain:

a) the registration application of topology (further - the statement);

b) the deposited materials identifying topology, including the paper;

c) the document confirming the bases for exemption of patent fee and reduction of its size, and also the payment document about payment of the state (patent) fee by foreign legal entities and physical persons for conducting state examination in the established size;

At the same time the Ministry independently checks payment of the state (patent) fee by legal entities and physical persons of the Republic of Uzbekistan by means of information systems without reclamation of additional documents.

In case of failure to pay the state (patent) fee in the established size legally significant actions for consideration of the application are not made;

d) in case of application by the authorized representative of the applicant the request shall contain in addition the power of attorney confirming powers of the authorized representative;

e) the request for registration relating to the topology used for commercial purposes before date of its giving in the Ministry shall contain in addition the document confirming date of the first use of this topology for commercial purposes.

§2. The general requirements imposed to document creation of the request for registration

5. Documents of the request for registration shall be processed so that they could be reproduced directly.

6. Documents of the request for registration shall be executed on sheets of strong, white, smooth, opaque, not glossy paper of the A4 format (210 x 297 mm) and each document shall begin on the single sheet.

7. The sizes of fields on sheets of documents of the request for registration shall be at least:

left - 20 mm;

upper - 15 mm;

right and lower - 10 mm.

8. In each document of the request for registration of the second and the subsequent sheets shall be numbered by the Arab figures.

9. Documents of the request for registration shall be printed by font of black color.

10. Documents of the request for registration shall be submitted, as a rule, on Uzbek or Russian. If the request for registration is constituted in other language, then full translation on Uzbek or the Russian executed and certified by the translator shall be attached to it.

11. The text of documents of the request for registration shall be complete and clear, not contain discrepancies.

12. Signatures on documents of the request for registration shall be deciphered with indication of surname and initials of name and middle name of the signing person.

In the signature on behalf of the legal entity the position of his head is specified.

13. Surnames, names and middle names in documents of the request for registration are specified in the Nominative case.

14. The full official name of the legal entity is provided in the request for registration.

§3. Requirements to the statement

15. The application is submitted in the TO-1 form according to appendix to these rules.

17. Columns 21 and 22 of the statement located over the word "statement" are intended for introduction of details after receipt in the Ministry and are not filled in with the applicant.

The information about the applicant (applicants) is provided in the column "applicant(s)" containing request for registration of topology under code 71: the official name of the legal entity (according to the constituent document) or surname, name and middle name (in the presence) physical person. Also in this column the location information or residence of applicants, including the official name of the country and the complete postal address is specified. Data on residence of the applicants who are authors of topology are not provided in this column, and stated only in the graph under code 97 on the second leaf of the statement.
