Based on the Art. 6, the Art. 164, the Art. 177, Art. 180 of the Customs code No. 95/2021 (The official monitor of the Republic of Moldova, 2021, No. 219 - 225, the Art. 238), based on the item 303, item 641 of the Regulations on enforcement of the Customs code approved by the Order of the Government No. 92/2023 (The official monitor of the Republic of Moldova, 2023, No. 93 - 96, to the Art. 193), I ORDER:

1. Approve Technical regulations of use of the simplified customs declaration and entering into accounting of the customs applicant, according to appendix.

2. Provisions of this order are brought to the attention of customs officers.

3. To impose control of execution of this order on Department of the income and customs control.

4. Declare invalid the Order of the director of Customs Service No. 565-O/2019 on approval of Technical regulations of application of the procedure of local customs clearance (The official monitor of the Republic of Moldova, 2020, No. 24 - 34, the Art. 89), registered in the Ministry of Justice behind number 1527/2020.

5. This order becomes effective since January 1, 2024.

Regulations concerning use of the simplified customs declaration and entering into accounting of the customs applicant

I. General provisions

1. This Regulations establish procedure for use of the simplified customs declaration and entering into accounting of the customs applicant.

2. Declaration of goods for the purpose of their room under customs regime can be performed according to the procedure of departure from submission of the standard customs declaration, based on the simplified declaration according to Art. 164 of the Customs code of the Republic of Moldova No. 95/2021, further - the Code, or entering into accounting of the customs applicant according to Art. 177 of the Code:

1) Transfer and processing of statements, and also the subsequent release and management of permissions, i.e. their change, response, cancellation and suspension, are performed with use of system of adoption of customs decisions (further - STR). The statement on receipt of permission to regular goods placement under customs regime based on the simplified declaration according to h (2) the Art. 164 of this Code and (or) permissions to submission of the customs declaration in the form of entering into accounting of the customs applicant and (or) permission to centralized customs clearance move the applicant electronically.

2) Before date of upgrade of the systems specified in article 6 of the Code, the central office of Customs Service allows use of other means, except electronic methods of data processing, concerning statements and decisions on permission to application of the simplified declaration and (or) the customs declaration in the form of entering into accounting of the customs applicant and (or) centralized customs clearance, or any subsequent event which can influence the initial statement or the decision.

3) In the cases provided by the subitem 2) of this Item following provisions are applied:

a) the statement for issue of permission to application of the simplified declaration and (or) the customs declaration in the form of entering into accounting of the customs applicant, centralized customs clearance moves according to the form given in appendix No. 25 to the Regulations on enforcement of the Customs code No. 95/2021, approved by the order of the Government No. 92/2023, and is filled in according to the instructions for filling given in appendix No. 1 to this Regulations;

b) permissions to use of the simplified declaration and/or the customs declaration in the form of entering into accounting of the customs applicant, centralized customs clearance are issued according to the form provided in appendix No. 2 to this Regulations;

c) within the centralized customs clearance permitted according to Art. 180 of the Code, requests belong to the modes provided by item 307 of the Provision. The owner of permission can submit on customs post, in the place where he located, the customs declaration on the goods shown to customs in other customs post.

3. Permission to regular goods placement under customs regime based on the simplified declaration according to h (2) Art. 164 of the Code is provided if the following conditions are satisfied in total:

1) the applicant corresponds to the criterion established in Art. 39 of the Code;

2) when applicable, availability at the applicant of satisfactory procedures of management of the licenses and permissions issued according to measures of trade policy;

The applicant provides 3) that target employees received task to inform Customs Service in case of detection of difficulties in observance of requirements, and establishes procedures for informing Customs Service on such difficulties;
