About approval of the Regulations on the rules applied for the purpose of simplification of international maritime traffic

Based on article 2 of the Law No. 13/2023 on accession of the Republic of Moldova to the Convention on simplification of international maritime traffic (FAL), with the made amendments (The official monitor of the Republic of Moldova, 2023, Art. No. 57-60, 106), the Government DECIDES:

1. Approve Regulations on the rules applied for the purpose of simplification of international maritime traffic it (is applied).

2. To impose control over the implementation of this resolution on the Ministry of infrastructure and regional development.

3. This resolution becomes effective since January 1, 2024.

Regulations on the rules applied for the purpose of simplification of international maritime traffic

Chapter I. General provisions

Section 1. Determinations

1. The regulations on the rules applied for the purpose of simplification of international maritime traffic (further - the Provision), determine formalities by submission of the reporting for the courts arriving, being on the parking and departing from the port of the Republic of Moldova according to the Convention on simplification of international maritime traffic (FAL), and also other measures which are carried out for the purpose of simplification and harmonization of the ministerial procedures applied in the field of water transport.

2. This Provision is applied to the courts performing the international flights which make calling the ports of the Republic of Moldova.

3. For the purpose of this provision the following values are applied:

the marine agent - the party representing the shipowner and/or the freighter (principal) in port. If the agent did not receive other instructions, he bears responsibility to the principal for the organization, together with port, the mooring, all corresponding port and economic services, with observance of requirements of the captain and crew, for registration of permissions to the vessel by port and other authorities (including registration and submission of the corresponding documentation), and also for issue and receipt of load on behalf of the principal;

the temporary admission - customs procedure by means of which certain loads can be imported on customs area in case of the caused release, fully or partially, from payment of the import taxes and duties and without application of import bans or restrictions of economic nature; such goods shall be imported with particular purpose and intend for re-export during the certain period of time, without being exposed to any changes, except for regular impairment because of their use;

competent authorities - the bodies of public management of the Republic of Moldova operating in the government mode responsible for application of the regulatory base according to the tasks containing in the Provision, such as: Boundary police, Customs Service, the Agency of water transport, the National agency on safety of foodstuff, the National agency of public health, the Agency of the environment, including their territorial subdivisions;

the baggage following with passengers - property, including currency, transported by the passenger on the same vessel, as the passenger irrespective of, there is it in its personal property or not, but provided that it is not transported under the agreement on transportation or other similar agreement;

the descent on the coast - permission to the crew member to be during the parking of the vessel in port, in borders of certain zone or ashore during limited time, in case of their availability which can be established by competent authorities;
