About additional measures for enhancement of system of protection of the rights of the child

For the purpose of further enhancement of system of protection of the rights, freedoms and legitimate interests of the child, providing guarantees of the rights of the child and creation of efficient system of accomplishment of the international obligations in this sphere:

1. Take into consideration that the resolution of the President of the Republic of Uzbekistan of April 22, 2019 No. PP-4296 "About additional measures for further strengthening of guarantees of the rights of the child" enters position of the Deputy Representative of Oliy Majlis of the Republic of Uzbekistan for human rights (ombudsman) - the Ombudsman for Children.

2. Determine the main objectives and activities of the Ombudsman for Children:

participation in development and strategy implementation of execution of the Convention of the United Nations on the rights of the child and other documents concerning the child's rights;

providing guarantees of protection of the rights, freedoms and legitimate interests of the child by consideration of appeals of physical persons and legal entities, including children and their legal representatives, about violation of the rights and legitimate interests of the child;

carrying out studying of execution of regulations and requirements of acts of the legislation on guarantees of the rights of the child;

implementation of monitoring of implementation in the legislation of international standards of the rights and freedoms of the child, and also observance of the rights of the child in activities of state bodies and other organizations within the powers;

regular informing public on condition of observance of the rights, freedoms and legitimate interests of the child and his protection;

rendering assistance in social adaptation of children with limited opportunities, and also orphan children and children without parental support, after the termination of child care educational facilities by them;

rendering assistance in providing the orphan children and children without parental support who graduated from educational organizations, the premises in municipal housing stock of purpose meeting sanitary, technical standards and other requirements of the legislation needing housing;

rendering assistance in enhancement of acts of the legislation on the rights, freedoms and legitimate interests of the child, introduction of offers on acceptance of the regulations aimed at providing the most priority interests of the child, including ratification of the international documents concerning the rights and freedoms of the child;

rendering assistance in enhancement of activities of state governing bodies, self-government institutions of citizens, non-state non-profit organizations and other institutes of civil society in the sphere of providing the rights, freedoms and legitimate interests of the child and his protection by provision of consultations, recommendations and the conclusions;

development of international cooperation in the sphere of providing the rights, freedoms and legitimate interests of the child.

3. Determine that:

The Ombudsman for Children (further - the Representative) performs the powers independently and irrespective of state bodies and their officials;

The representative has the right of immunity and cannot be brought to trial, is detained, taken into custody or subjected to the measures of administrative punishment imposed judicially without the consent of chambers of Oliy Majlis of the Republic of Uzbekistan;

criminal case concerning the Representative can be brought only by the Attorney-General of the Republic of Uzbekistan;

the forced drive, detention, and equally in examination of personal belongings, baggage, transport, residential and the office of the Representative is not allowed;

The representative of Oliy Majlis of the Republic of Uzbekistan for human rights (ombudsman) coordinates activities of the Representative;

The representative annually, no later than February 15 of the year following reporting represents to chambers of Oliy Majlis of the Republic of Uzbekistan the report on condition of observance of acts of the legislation on protection of the rights, freedoms and legitimate interests of the child by the state, including law enforcement agencies;

use in accordance with the established procedure databases of state bodies;

together with authorized state bodies, officials and representatives of the non-state organizations to check messages on the facts of violation of the rights, freedoms and legitimate interests of the child;

submit for consideration of the Constitutional court of the Republic of Uzbekistan questions according to the law;

participate in meetings of the Constitutional court of the Republic of Uzbekistan and state the line item on all questions considered by court;

bring addressed to heads of state bodies and the organizations ideas of violations of acts of the legislation, obligatory to consideration, in the sphere of the rights of the child, elimination of the reasons and conditions promoting them within monitoring of situation and consideration of addresses in the sphere of the rights of the child;

bring in relevant organs of the petition for accountability of persons in which actions violations of the rights and freedoms of the child are revealed;

turn to the courts with statements and claims for protection of the violated rights, freedoms and legitimate interests of the child in the cases provided by the law;

personally or through the representative to take part in legal procedures for the purpose of protection and recovery of the violated rights, freedoms and legitimate interests of the child in the cases and forms established by the law;

conduct surveys among the population on the questions connected with the child's rights, collect statistical data and create the database about realization of the rights of the child;
