ORDER OF THE MINISTRY OF AGRICULTURAL POLICY AND FOOD OF UKRAINE

of August 31, 2023 No. 1609

About approval of the Procedure for creation, giving and consideration of the request for grade

According to Article part two 20, of Articles 25, 34 and 35 Laws of Ukraine "About protection of the rights to plant varieties", Item 8 of the Regulations on the Ministry of Agricultural Policy and Food of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of February 17, 2021 No. 124, and for the purpose of reduction of regulatory legal acts in compliance with requirements of the legislation of Ukraine ORDER:

1. Approve the Procedure for creation, giving and consideration of the request for the enclosed grade.

2. Recognize to invalid:

the order of Public service on protection of the rights to plant varieties of March 12, 2003 "About approval of procedure for distribution in Ukraine of grade to which the exclusive right of the owner does not extend" is registered No. 3-2/139-43 in the Ministry of Justice of Ukraine on March 27, 2003 at No. 241/7562;

the order of the Ministry of agrarian policy of Ukraine of May 28, 2003 No. 151 "About approval of the Regulations on the certificate on authorship to plant variety", registered in the Ministry of Justice of Ukraine on June 11, 2003 at No. 470/7791;

the order of the Ministry of Agricultural Policy and Food of Ukraine of February 28, 2018 No. 110 "About approval of Rules of creation and application for plant variety", registered in the Ministry of Justice of Ukraine on July 05, 2018 at No. 781/32233.

3. To provide to department of agrarian development submission of this order on state registration in the Ministry of Justice of Ukraine in the procedure established by the legislation.

4. This order becomes effective from the date of its official publication.

5. To impose control over the implementation of this order on the deputy minister of agrarian policy and food of Ukraine according to distribution of obligations.
