About procedure for forming and providing national militia

Based on Article part six 7, No. 287-Z "About national militia" the Council of Ministers of the Republic of Belarus DECIDES: parts four of Article 8 and paragraphs of the third or fifth of article 15 of the Law of the Republic of Belarus of July 17, 2023

1. Approve Regulations on procedure for forming and providing national militia it (is applied).

2. To republican state bodies, local executive and administrative organs in three-months time to bring the regulatory legal acts into accord with this resolution, and also to take other measures for its realization.

3. This resolution becomes effective after its official publication.

Regulations on procedure for forming and providing national militia

Chapter 1. General provisions

1. This Provision determines procedure for forming (disbandment) for national militia, completing and accounting of volunteers of national militia (further, unless otherwise specified, – the volunteer), transfers of volunteers in national militia and exit from it, and also procedure for preparation and ensuring their activities.

2. For the purposes of this provision terms and their determinations in the values established by the Law of the Republic of Belarus "About national militia" and also the following terms and their determinations are used:

group of national militia – the structural division of group of national militia consisting of volunteers and intended for accomplishment of specific objective of national militia under the leadership of the deputy commander of group;

training of volunteers – complex of the events held by local executive and administrative organs aimed at providing readiness of groups of national militia for accomplishment of tasks on purpose;

preparation for forming of national militia – complex of the state bodies of the organizational actions aimed at providing readiness of local executive and administrative organs for timely forming of groups of national militia which are carried out to peace time by officials;

forming of national militia – complex of organizational and practical actions for completing of groups of national militia by volunteers, to their preparation, providing with weapon and ammunition.

3. The structure and number of groups of national militia are determined taking into account amount, specifics of the tasks which are carried out by them, and also frequency and methods of their accomplishment. Proceeding from the principles of controllability the optimum number of group, as a rule, shall not exceed 100 people, groups of national militia – 20 people.

4. The main methods of accomplishment of tasks by groups of national militia are patrol and exposure of posts on streets, sites of the area and objects for prevention and suppression of offenses.

Chapter 2. Preparation for forming of national militia

5. For preparation for forming of national militia by chairmen of regional executive committees (The Minsk Gorispolkom) in peace time the order at which terms of preparation and the direction are determined by local executive and administrative organs of primary territorial level (further, unless otherwise specified, – executive committee of primary level, local administrations) offers on forming of national militia is published.

6. The executive committee of primary level, local administration together with territorial authority of internal affairs in peace time perform preparation of offers on forming of national militia in which are determined:

the tasks planned to accomplishment by groups of national militia, the place and procedure for their accomplishment (the patrol routes, infrastructure facilities and communications which are subject to protection and defense);

reasonable quantity and structure of groups of national militia, their number;

the list of persons planned to appointment as commanders of groups of national militia and their deputies;

list of actions and amount of the material resources necessary for ensuring activities of groups of national militia;

the list of the parcels of land (buildings, constructions, rooms) planned to allocation for needs of groups of national militia, action for their preparation.

The offers specified in parts one of this Item, executive committees of primary level send local administrations for consideration to local executive and administrative organs of basic territorial level (further – executive committee of basic level).

7. Executive committee of basic level:

considers and generalizes offers of executive committees of primary level, local administrations;

makes the decision on procedure for forming of national militia in which establishes the list of groups of national militia, their name, structure and number, places, areas, objects where it is planned to use groups of national militia, determines procedure for their preparation;

sends the copy of the made decision to the relevant regional executive committee, territorial authority of internal affairs and local body of military management, and the statement from it – in executive committees of primary level;

carries out work on selection of persons planned to appointment as commanders of groups of national militia and their deputies;

approves the personalized list of persons in form according to appendix 1, of the groups of national militia planned to appointment as commanders and their deputies;

notifies executive committee of primary level, territorial authority of internal affairs, the state security agency and local body of military management on results of selection.

8. Regional executive committee:

generalizes number planned to creation in the field of groups of national militia;

informs the Ministry of Defence on required quantity of weapon and ammunition for providing groups of national militia;

provides coordination and control of work of subordinate executive committees of basic and primary level concerning creation and activities of groups of national militia.

9. Minsk Gorispolkom:

generalizes the number of the groups of national militia planned to creation in Minsk;

informs the Ministry of Defence on required quantity of weapon and ammunition for providing groups of national militia;

provides coordination and control of work of subordinate local administrations concerning creation and activities of groups of national militia.
