1. Approve the enclosed Rules of forming and maintaining the register of the goods, works and services used when carrying out transactions on subsurface use on hydrocarbons and production of uranium and their producers, including criteria of their assessment for entering into this register.

2. To provide to department of subsurface use of the Department of Energy of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy in paper and electronic type in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) within ten calendar days after state registration of this order the direction it the copy on official publication in periodic printing editions;

4) placement of this order on Internet resource of the Department of Energy of the Republic of Kazakhstan after its official publication;

5) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Department of Energy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 2), 3) and 4) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Energy of the Republic of Kazakhstan.

4. This order becomes effective since June 29, 2018 and is subject to official publication.

Rules of forming and maintaining the register of the goods, works and services used when carrying out transactions on subsurface use on hydrocarbons and production of uranium and their producers, including criteria of their assessment for entering into this register

Chapter 1. General provisions

1. These rules of forming and maintaining the register of the goods, works and services used when carrying out transactions on subsurface use on hydrocarbons and production of uranium and their producers, including criteria of their assessment (further – Rules) are developed for entering into this register according to subitem 3-2) of Article 62 and subitem 3-2) of article 63 of the Code of the Republic of Kazakhstan "About subsoil and subsurface use" (further – the Code) and determine procedure for forming and maintaining the register of the goods, works and services used when carrying out transactions on subsurface use on hydrocarbons and production of uranium and their producers, including criteria of their assessment for entering into this register (further – the Register).

2. In Rules the concepts and determinations established in the Code and also the following concepts are used:

1) authorized body in the field of hydrocarbons and production of uranium – the authorized body realizing state policy in the field of hydrocarbons and production of uranium.

2) producer - the physical person or legal entity making and (or) delivering goods, and (or) performing works, and (or) rendering the services used when carrying out transaction on subsurface use.

3. The register is created and kept by authorized body in the field of hydrocarbons and production of uranium.

Chapter 2. Procedure for forming and maintaining register

4. Forming in the Register of data on the goods, works and services used when carrying out transactions on subsurface use is performed based on data of annual and medium-term programs of purchase of the goods, works and services represented by subsoil users to authorized body in the field of hydrocarbons and production of uranium in the form and rules approved according to Item 6 of Article 131 and Item 6 of article 179 of the Code.

5. As forming and maintaining the Register it is understood:

1) introduction of data on the goods, works and services used when carrying out transactions on subsurface use and their producers in the Register;

2) updating of the Register in case of change of the data provided by producers and also in case of exception of producers of the Register;

3) updating of the Register in case of change of the data provided by subsoil users;

4) placement of the Register in the state information system "The Register of the Goods, Works and Services Used when Carrying Out Transactions on Subsurface Use and Their Producers" in form, according to appendix 1 to these rules.

6. Local executive bodies (areas, the cities of republican value, the capital) represent to authorized body in the field of hydrocarbons and production of uranium the inventory, the works and services made in the territory of the area (the city of republican value, the capital) and their producers, according to appendix 2 to these rules.

7. The authorized body in the field of hydrocarbons and production of uranium for the purpose of forming and maintaining the Register sends the notification to the producers electronically brought in the data provided by local executive bodies (areas, the cities of republican value, the capital) about possibility of their entering into the Register and data on the goods offered by them, works, services used when carrying out transactions on subsurface use.
