About approval of the Procedure for forming of pool of subjects to privatization

According to part one of article 1 of the Law of Ukraine "About privatization of the state-owned and municipal property" the Cabinet of Ministers of Ukraine decides:

Approve the Procedure for forming of the enclosed pool of subjects to privatization.

Approved by the Resolution of the Cabinet of Ministers of Ukraine of July 14, 2023, No. 715

Procedure for forming of pool of subjects to privatization

1. This Procedure determines the procedure of forming from several subjects to small and/or big privatization of pool as single subject to privatization.

2. The pool can be subject to small privatization or subject to big privatization.

3. The pool is created of such subjects to privatization:

single property complexes of the state or municipal companies, in particular the single property complexes leased;

blocks of shares (shares) belonging to the state or territorial community in the authorized capital of economic societies.

4. The pool is created of two or more subjects to privatization determined by Item 3 presents of the Procedure if one of the following conditions is carried out:

the companies or the relevant economic societies perform economic activity in one industry of economy within one section of Classification of types of economic activity;

products of one company or relevant economic society are or can be the raw materials, the basic or auxiliary material, components intended for production of other company or the relevant economic society.

5. The pool is created of subjects to privatization concerning which the decision on privatization and not promulgated information message on sale, or objects which are not sold according to the procedure, provided by parts eight - the eleventh Article 15 or part of the sixteenth article 19 of the Law of Ukraine "On privatization of the state-owned and municipal property" is made.

6. Privatization authorities handle issues of forming of pool of subjects to privatization taking into account requirements of item 4 of this Procedure based on the offers provided:

authorized bodies of management, - concerning subjects to privatization of state-owned property;

local government bodies, - concerning subjects to privatization of municipal property.

7. The decision on forming of pool as single subject to small privatization of state-owned property is accepted by state bodies of privatization by the publication of the order.

8. State bodies of privatization within 30 days from the date of forming of pool as subject to small privatization of state-owned property include it as single subject to privatization in the list of subjects to small privatization of state-owned property, privatizeable.

9. The decision on forming of pool as subject to big privatization of state-owned property and its inclusion in the list of subjects to big privatization of state-owned property, privatizeable, is accepted by the Cabinet of Ministers of Ukraine on representation of Fund of state-owned property after decision making about privatization of each of objects of which the pool is created.

10. The decision on privatization of pool which is included in the corresponding list is accepted by state bodies of privatization by the publication of the order within 30 days from the date of inclusion of pool in the list of objects of state-owned property, privatizeable.

11. The decision on forming of pool as single subject to privatization of municipal property is accepted by privatization authorities of territorial communities after decision making about privatization of each of objects of which the pool is created.

12. The decision on inclusion of pool as single subject to privatization of municipal property in the list of objects of municipal property, privatizeable, is accepted by representative body of local self-government within 30 days from the date of forming of pool as subject to privatization.

13. The decision on privatization of pool which is included in the list of objects of municipal property privatizeable, is accepted by privatization authorities of territorial communities within 30 days from the date of inclusion of pool as single subject to privatization in the list of objects of municipal property, privatizeable.

14. Privatization authorities stop privatization of pool in case of the termination of privatization of the pool or object which is part of pool in the cases provided by part six of article 12 of the Law of Ukraine "About privatization of the state-owned and municipal property".

15. Before completion or the termination of privatization of pool of action for privatization of objects from which the pool is created are not performed.

16. After the termination of privatization of pool subjects to privatization from which the pool was created are subject to privatization according to the procedure, established by the Law of Ukraine "About privatization of the state-owned and municipal property".
