Some questions of accomplishment of investing programs in the field of management of household waste

According to part four of article 36 of the Law of Ukraine "About waste management" the Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure of control over the implementation of investing programs in the field of management of household waste which is applied.

2. Determine that:

limit of cost of investments which can be attracted on investing programs in the field of management of household waste which join when calculating economically reasonable expenses for implementation of actions for updating of fixed assets, construction, reconstruction, upgrade, technical retrofitting of objects of processing of household waste is the actual effective interest rate on which the subject of managing in the field of management of household waste attracts investments and which cannot exceed the size of discount rate of National Bank plus 3 percent;

subjects of managing in the field of management of household waste attract investments in amounts which can be returned during the term of accomplishment of investing programs in the field of management of household waste without emergence of risk of loss of financial independence by them;

the deadline of action of investing programs in the field of management of household waste cannot be less than the term of complete repayment of obligations on them.

Procedure of control over the implementation of investing programs in the field of management of household waste

1. This Procedure determines the mechanism of control of accomplishment of investing programs in the field of management of household waste (further - investing programs).

2. In this Procedure terms are used in the value given in the Law of Ukraine "About waste management".

3. Action of this Procedure extends to the subjects of managing in the field of management of household waste performing transactions on recovery and/or removal of household waste according to the established executive bodies of village, settlement, city councils of rates for recovery and/or removal of household waste (further - subjects of managing).

4. Control over the implementation of investing programs of subjects of managing is exercised by executive bodies of village, settlement, city councils (further - authorized body).

5. Control over the implementation of investing program is exercised for the purpose of carrying out monitoring:

conditions of accomplishment of investing program, including adherence to deadlines of its accomplishment;

the actual results of implementation of actions of investing program, expenses on which implementation are included in tariffs on recovery and/or removal of household waste.

6. Subjects of managing in case of accomplishment of investing program shall hold to the financial plan of use of the means provided for its accomplishment, and the schedule of implementation of actions of such program with use of the specified means.

7. For the purpose of carrying out monitoring of accomplishment of investing programs subjects of managing give quarterly to the last date following the accounting period and within 60 calendar days after the termination of term of accomplishment of investing program to authorized bodies in electronic or paper form such reporting materials:

explanatory note;

the report on implementation of actions of investing program and use of the means provided for their implementation for the accounting period on form according to appendix.

The specified report contains the following Sections and subsections:

I. Recovery of household waste:

development of project and technical documentation;

acquisition of the works, goods and services directed to updating of fixed assets, construction, reconstruction, upgrade and technical retrofitting of objects of processing of household waste;

increase in efficiency of processing of waste, optimization of production processes;

improvement of quality and amounts of provision of services;

II. Removal of household waste:

development of project and technical documentation;

acquisition of the works, goods and services directed to updating of fixed assets, construction, reconstruction, upgrade and technical retrofitting of objects of processing of household waste;

increase in efficiency of processing of waste, optimization of production processes;

improvement of quality and amounts of provision of services.

In case of implementation not in full of actions of investing program in the explanatory note the reasons are specified and the corresponding reasons are provided.

8. The authorized body carries out the analysis of reporting materials, the stipulated in Item 7 presents About, within 20 working days from the date of their receipt.

The analysis of reporting materials on accomplishment of investing program includes check:

adherence to deadlines of implementation of actions of investing program;

achievement of planned measure values which list is determined by the requirements established to content of investing programs of subjects of managing and which achievement is provided in result of implementation of the relevant activities of investing program;

compliance of actually performed actions of investing program to the measures provided by investing program in case of its approval.

9. By results of carrying out the analysis and check by authorized body of the reporting materials provided by the subject of managing on implementation of actions of investing program the authorized body draws up the statement of results of accomplishment of investing program which contains conclusions about accuracy of the data, provided by the subject of managing, and also about completeness of implementation by the subject of managing of actions for accomplishment of investing program on the basis of verification of the data determined by Item 8 of this Procedure.
