About modification of some legal acts of Ukraine concerning reforming of employment service, social insurance on unemployment case, assistance of productive employment of the population, including youth, and implementation of new active programs in the labor market

The Verkhovna Rada of Ukraine decides:

I. Make changes to such legal acts of Ukraine:

1. Article 196 of the Labor code of Ukraine (1971, appendix to No. 50, the Art. 375) to exclude sheets of the Verkhovna Rada of USSR.

2. In the Law of Ukraine "About obligatory national social insurance on unemployment case" (Sheets of the Verkhovna Rada of Ukraine, 2000 p., No. 22, Art. 171 with the following changes):

The second and fifth Article 6 to state 1) to part in the following edition:

"2. The right to providing and social services according to this Law have also:

the youth which finished or stopped training in organizations of general average, professional (professional), professional prehigher and higher education left from conscription military or alternative (not military) service and needs assistance in employment on the first workplace in case of registration in accordance with the established procedure of the corresponding persons as the unemployed;

lonely mother (father) who, (which) performs child care with disability, and one of parents, adoptive parents, parents tutors of orphanage of family type, the adoptive father, the guardian, the child's custodian with disability of subgroup And which according to the Law of Ukraine "About the government public assistance to persons with disability since the childhood and to children with disability" have the right to purpose of the allowance to child care in case of registration in accordance with the established procedure of the corresponding persons as the unemployed";

"5. The working pensioners in case of the appeal to territorial authority of the central executive body realizing state policy in the field of employment of the population and labor migration behind assistance in employment have the right to social services in search of suitable work, and also to the information and consulting services connected with employment, preventive actions according to article 7-1 of this Law";

2) in Article 7:

add part one with the paragraph the seventh the following content:

"The procedure for provision of the specified benefits is determined by the Cabinet of Ministers of Ukraine";

"2. Types of social services in this law and the Law of Ukraine "About employment of the population" are:

professional training or retraining, advanced training in organizations of professional (professional), professional and higher education, at the companies, in organizations, the organizations;

career guidance;

individual planning of employment;

search of suitable work and assistance in employment, including by the organization of social jobs and other works of temporality for the unemployed according to the procedure, established by the Cabinet of Ministers of Ukraine;

other services connected with employment stipulated by the legislation;

services for employers;

provision to employers who employ citizens, in particular such which have additional guarantees in assistance to employment, compensations according to article 26 of the Law of Ukraine "About employment of the population";

Assistance of employment of registered unemployed persons according to article 26-1 of the Law of Ukraine "About employment of the population";

provision to employers small business entities who employ the unemployed, compensations according to article 27 of the Law of Ukraine "About employment of the population";

provision of one-time financial aid for the organization of business activity according to article 27 of the Law of Ukraine "About employment of the population";

provision of the voucher for maintenance of competitiveness of some categories of citizens in the way: retrainings by working profession; preparation in the specialty for receipt of degree of the master on the basis of the degree of the bachelor or the master received on other specialty; preparation at the following education level (except third (образовательно-научного/образовательно-творческого) the level of the higher education); specializations and advanced trainings by professions and specialties according to article 30 of the Law of Ukraine "About employment of the population";

implementation of measures of assistance of employment of internally displaced persons according to article 24-1 of the Law of Ukraine "About employment of the population";

assistance on partial unemployment according to article 47 of the Law of Ukraine "About employment of the population";

other programs of assistance of employment of the population which are entered by separate decisions of the Cabinet of Ministers of Ukraine;

the information and consulting services connected with employment.

In case of need for passing of professional training or retraining, advanced training person:

goes to healthcare institutions for passing preliminary medical, narcological and psychiatric surveys according to the legislation;

it is provided with the place of residence for passing of professional training or retraining, advanced training and expenses on transportation to the place of training and in the opposite direction according to the procedure, established by the central executive body providing forming of state policy in the field of work, employment relationships and employment of the population in coordination with board of Fund of obligatory national social insurance of Ukraine on unemployment case are compensated to it";

Part third of Article 10 to state 3) in the following edition:

"3. Person who is not citizen of Ukraine or having criminal record for making of the intentional criminal offense, corruption criminal offense and criminal offense connected with corruption cannot represent the party if this criminal record is not extinguished and is not removed in the procedure established by the law, and also person dismissed from the last place of employment (service) on the bases provided by part one Items 7-7-3 of Article 36, Items 3, of 4, of 7, 8 parts one of Article 40, Articles 41 (except part one Items 5 and 6) and 45 Labor codes of Ukraine, Items 3, of 4, of 4-1 part one of article 84 of the Law of Ukraine "About public service", Items 6 and 10 of part one of article 77 of the Law of Ukraine "About National police", Items 3, 3-1, 5 parts one of article 51 of the Law of Ukraine "About prosecutor's office", Items 3-3-2 of part one of article 79 of the Law of Ukraine "About local self-government in Ukraine", and also on the similar bases determined by other laws";

Article 16 to state 4) in the following edition:

"Article 16. Budget of Fund, sources of fund and their use

1. The budget of Fund - the plan of forming of financial resources at the expense of part of single fee on obligatory national social insurance and other receipts which are not prohibited by the law and their use for ensuring accomplishment of the tasks and functions provided by this Law and the Law of Ukraine "About employment of the population".

The procedure for creation and budget implementation of fund is established by board of Fund.

2. Sources of forming of fund are:

1) insurance premiums of insurers;

2) the amounts of the financial sanctions applied according to this law and the Law of Ukraine "About employment of the population", other laws of the companies, organizations, the organizations and physical persons - entrepreneurs for violation of established procedure of payment of insurance premiums and use of fund, non-compliance with the legislation on employment of the population, and also amount of the administrative penalties put according to the law on officials and citizens for such violations;

3) the funds of the government budget allocated in fund in the cases established by the law;

4) income from placement of temporarily available funds, including reserve of fund;

5) charitable fees of the companies, organizations, organizations;

6) other receipts according to the legislation of Ukraine.

3. Budget funds of Fund are used on:

1) payment of material security and provision of social services, stipulated in Article 7 these Laws, financing of actions, stipulated in Article 7-1 this Law;

2) implementation of actions according to the Law of Ukraine "About employment of the population";
