About introduction of amendments to some orders of the Ministry for Investments and Development of the Republic of Kazakhstan

I ORDER:

1. Bring the following changes in some orders of the Ministry for Investments and Development of the Republic of Kazakhstan:

1) in the order of the acting minister on investments and development of the Republic of Kazakhstan of January 23, 2015 No. 49 "About approval of Rules of state registration of vehicles of urban rail transportation" (it is registered in the Register of state registration of regulatory legal acts for No. 10407, it is published on March 17, 2015 in information system of law of Ad_let):

The rules of state registration of vehicles of urban rail transportation approved by the specified order to be reworded as follows according to appendix 1 to this order;

2) in the order of the acting minister on investments and development of the Republic of Kazakhstan of March 26, 2015 No. 333 "About approval of Rules of state registration (re-registration) of railway vehicles and its pledge, and also exception of the State register of railway vehicles" (it is registered in the Register of state registration of regulatory legal acts for No. 11119, it is published on June 18, 2015 in information system of law of Ad_let):

Rules of state registration (re-registration) of railway vehicles and its pledge, and also exceptions of the State register of railway vehicles approved by the specified order to be reworded as follows according to appendix 2 to this order.

2. To provide to committee of transport of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising vice-minister of the industry and infrastructure development of the Republic of Kazakhstan.

4. This order becomes effective after twenty one calendar days after day of its first official publication.

Rules of state registration of vehicles of urban rail transportation

Chapter 1. General provisions

1. These rules of state registration of vehicles of urban rail transportation (further - Rules) are developed according to article 15-1 of the Law of the Republic of Kazakhstan of September 21, 1994 "About transport in the Republic of Kazakhstan" and the subitem 1) of article 10 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state services" and determine procedure for state registration of vehicles of urban rail transportation and rendering the state service state registration of vehicles of urban rail transportation.

2. State registration of vehicles of urban rail transportation in the Republic of Kazakhstan is performed by local executive bodies of the cities of Almaty, Pavlodar, Ust-Kamenogorsk and Temirtau (further - the service provider).

3. In these rules the following concepts are used:

1) easily rail transport - the type of urban rail transportation which is characterized smaller than at the subway and rail transport, and big, than at the tram the speed of the message and handling capacity;

2) urban rail transportation - mode of transport (the subway, the tram, easily rail, monorail transport) intended for transportation of passengers in the ways in borders of the city and residential suburb;

3) the subway - type of urban rail transportation, the passengers performing regular socially important transportations and baggage in the ways isolated (separated, which do not have single-level crossings) from lines of other modes of transport and pass of pedestrians to them;

4) monorail transport - the type of urban rail transportation intended for movement on one railway line;

5) the register - the database containing data on the registered vehicles of urban rail transportation in the Republic of Kazakhstan;

6) the tram - the type of urban rail transportation intended for transportation of passengers along the set routes in city borders.

4. Vehicles of urban rail transportation are not subject to state registration in cases of temporary import on the territory of the Republic of Kazakhstan by nonresidents of the Republic of Kazakhstan for repair.

Chapter 2. Procedure for state registration of vehicles of urban rail transportation

5. State registration of vehicles of urban rail transportation appears the service provider:

1) in place of registration of the legal entity if applicant is the legal entity;

2) in place of registration as the taxpayer if applicant are the physical person, including the individual entrepreneur.

6. State registration of vehicles of urban rail transportation is the state service (further – the state service) for which receipt physical person or legal entity (further – the uslugopoluchatel) submits to the service provider the application in form according to appendix 1 to these rules through the web portal of "the electronic government" www.egov.kz, www.elicense.kz (further – the portal).

The list of the main requirements to rendering the state service including characteristics of process, form, content and result of rendering, and also other data taking into account features of provision of the state service are stated in the Standard of the state service in form according to appendix 2 to these rules.

On the portal in "personal account" of uslugopoluchatel the status about acceptance of request for rendering the state service with indication of the date of receipt of result of the state service is displayed.

The office of the service provider in day of receipt of documents performs their acceptance, registration and transfers to execution to responsible structural division. In case of the address of uslugopoluchatel after the termination of working hours, in days off and holidays according to the labor law, reception of applications and issue of results of rendering the state service is performed the next working afternoon.

The employee of responsible structural division of the service provider within 1 (one) working day from the moment of document registration, checks completeness of the submitted documents.

The data on the document proving the identity, on state registration (re-registration) of the legal entity, on state registration of the individual entrepreneur, on registration (re-registration) of vehicles of urban rail transportation, confirming payment of the registration fee, in case of payment through payment gateway of "the electronic government", the service provider receives from the corresponding information systems through lock of "the electronic government".

7. In representation cases uslugopoluchatel of incomplete document package according to the list, and (or) documents with the expired effective period the service provider in the specified time refuses further review of the statement and sends the notification to "personal account" of the uslugopoluchatel in electronic form signed by the digital signature (further – the EDS) the authorized person of the service provider.

8. In case of representation the uslugopoluchatel of complete document package, the service provider within 1 (one) working day check reliability of the submitted documents and compliance of uslugopoluchatel and (or) the submitted documents and the certificate on state registration of vehicles of urban rail transportation in form, according to appendix 3 to these rules (further – the certificate) and (or) notices on exception of vehicles of urban rail transportation of the register of vehicles of urban rail transportation or the motivated answer on refusal in rendering the state service which goes to "personal account" of the uslugopoluchatel in electronic form signed by the EDS of the authorized person of the service provider is drawn up.
