About approval of Rules of maintaining the State register of international treaties of the Republic of Kazakhstan

1. Approve the enclosed Rules of maintaining the State register of international treaties of the Republic of Kazakhstan.

2. To provide to international legal department of the Ministry of Foreign Affairs of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Foreign Affairs of the Republic of Kazakhstan;

3) within ten working days after state registration in the Ministry of Justice of the Republic of Kazakhstan of this order submission to Department of legal service of the Ministry of Foreign Affairs of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising deputy minister of foreign affairs of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of maintaining the State register of international treaties of the Republic of Kazakhstan

Chapter 1. General provisions

1. These rules of maintaining the State register of international treaties of the Republic of Kazakhstan (further - Rules) determine order of registration, accounting and storage of the international treaties signed by the Republic of Kazakhstan with foreign state and (or) with the international organization(s) according to the Law "About International Treaties of the Republic of Kazakhstan" (further - the international agreements).

2. The international contracts signed on behalf of the Republic of Kazakhstan, the Government of the Republic of Kazakhstan and state bodies of the Republic of Kazakhstan, directly subordinate and accountable to the President of the Republic of Kazakhstan, and also the central executive bodies of the Republic of Kazakhstan are subject to registration, accounting and storage (further - the central bodies).

3. The state register of international treaties of the Republic of Kazakhstan - the single state system of registration, accounting and storage of international treaties of the Republic of Kazakhstan containing originals and officially the copies of international treaties certified by depositary, their details and other information of directory nature about them determined by the Ministry of Foreign Affairs of the Republic of Kazakhstan.

4. The single state system of registration, accounting and storage of international treaties of the Republic of Kazakhstan is under authority of the Ministry of Foreign Affairs of the Republic of Kazakhstan (further - authorized body).

Chapter 2. Registration of international treaties

5. The central body from the date of the conclusion of the international treaty on behalf of the Republic of Kazakhstan or the Government of the Republic of Kazakhstan sends to two weeks to authorized body its original for registration.

6. When obtaining through diplomatic channels of the original or officially the verified copy of the international treaty signed on behalf of the Republic of Kazakhstan or the Government of the Republic of Kazakhstan, the authorized body performs registration of the corresponding international treaty independently.

7. In case of the conclusion of the international treaty on behalf of the central body the copy of the corresponding international treaty certified by the central body goes to two weeks from the date of the conclusion of the international treaty to authorized body.

In case of obtaining from depositary (the international organization or foreign state) officially of the verified copy of the international treaty the central body sends it to authorized body to two weeks from the moment of obtaining.

8. The reference signed by the head of the central body for form, according to appendix to these rules is attached to the original or officially the copy of the international treaty certified by depositary.

9. In case of receipt of the original or officially the verified copy of the international treaty, and also the enclosed reference to it the authorized body within fifteen working days establishes compliance of the international treaty and procedure for its conclusion to Articles 2, 8-10 Laws of the Republic of Kazakhstan of May 30, 2005 "About international treaties of the Republic of Kazakhstan" (further - the Law).

10. In case of establishment of compliance to Articles 2, 8-10 Laws the authorized body includes the international treaty in the State register of international treaties of the Republic of Kazakhstan. The international treaty which is not conforming to the established requirements of the Law returns within fifteen working days to the central body with motivated reasons for return reasons and recommendations of necessary actions for registration.

11. In case of registration of international treaties the log entry of registration of international treaties is made.

12.
