About modification and amendments in the order of the Minister of Education and Science of the Republic of Kazakhstan of October 30, 2018 No. 595 "About approval of Standard rules of organization activity of formation of the corresponding types"

I ORDER:

1. Bring in the order of the Minister of Education and Science of the Republic of Kazakhstan of October 30, 2018 No. 595 "About approval of Standard rules of organization activity of formation of the corresponding types" (it is registered in the Register of state registration of regulatory legal acts for No. 17657) the following changes and amendments:

to state heading of the order in the following edition:

"About approval of Standard rules of organization activity of formation of the corresponding types and types";

To be reworded as follows the appendix 1 approved by the specified order according to appendix 1 to this order;

To be reworded as follows the appendix 2 approved by the specified order according to appendix 2 to this order;

In appendix 3 Standard rules of organization activity of technical and professional education approved by the specified order:

state Item 1 in the following edition:

"1. These Standard rules of organization activity of technical and professional education, (further - Rules) are developed according to the Law of the Republic of Kazakhstan "About education" (further - the Law "About Education") and determine procedure for organization activity of technical and professional education (further - the TIPO organization), irrespective of patterns of ownership and departmental subordination.

"1-1. In these Standard rules the following concepts are used:

1) dual training - form of the training combining training in the organization of education with the obligatory periods of inservice training and professional practice at the company (in the organization) with provision of workplaces and compensation payment to students in case of equal responsibility of the company (organization), educational institution and the student;

2) college - the educational institution realizing educational programs of general secondary, technical and professional education

3) the highest college - the educational institution realizing the integrated modular educational programs of general secondary, technical and professional, postsecondary education;

4) school - the educational institution realizing educational programs of the main average, general secondary, technical and professional or postsecondary education in the field of culture.

5) technical and professional education - the education directed to training of skilled workers of personnel and specialists of average link.";

"2. Technical and professional education is acquired in schools, colleges and the highest colleges based on the main average and (or) general secondary, technical and professional education according to the state obligatory standard of technical and professional education approved by the order of the Minister of Education and Science of the Republic of Kazakhstan of October 31, 2018 No. 604 "About approval of the state obligatory standards of formation of all education levels" (it is registered in the Register of state registration of regulatory legal acts at No. 17669).";

Organization types of TIPO are determined in compliance by the order of the Minister of Education and Science of the Republic of Kazakhstan of February 22, 2013 No. 50 "About approval of the nomenclature of organization types of education" (it is registered in the Register of state registration of regulatory legal acts at No. 8390).";

"3. Tasks of the TIPO organizations are:

1) creation of necessary conditions for receipt of the quality education directed to forming, development and professional formation of the personality on the basis of national and universal values, achievements of science and practice;

2) development of creative, spiritual and physical capacities of the personality, forming of strong bases of morality and healthy lifestyle, enrichment of intelligence by creation of conditions for identity development;

3) education of civic consciousness and patriotism, love to the Homeland - the Republic of Kazakhstan, respect for the state symbols and state language, honoring of national traditions, intolerance to any anticonstitutional and antisocial manifestations;

4) education of the personality with active civic stand, forming of requirements to participate in social and political, economic and cultural life of the republic, the conscious relation of the personality to the rights and obligations;

5) familiarizing with achievements of domestic and world culture; studying of history, customs and traditions Kazakh and other people of the republic; mastering Kazakh, Russian, foreign languages;

6) ensuring increase in the social status of teachers;

7) expansion of autonomy, independence of the organizations of education, democratization of management of education;

8) functioning of national system of the quality evaluation of education meeting requirements of society and economy;

9) implementation and effective use of new technologies of training, including credit, the information and communication, promoting bystry adaptation of professional education to the changing requirements of society and the labor market;

10) development of the training systems during life providing interrelation between general training, factory training and requirements of the labor market and helping everyone to use as much as possible the personal potential in society based on knowledge and competence;

11) integration of education, science and production;

12) ensuring professional motivation of students;

13) ensuring the advancing development of technical and professional education by active interaction with employers and other social partners;

14) creation of special conditions taking into account specific features of students.";

"4. The TIPO organizations perform the activities according to the Constitution of the Republic of Kazakhstan, the laws of the Republic of Kazakhstan, these rules and charters of the TIPO organizations according to article 41 of the Law "About Education".";

"8-1. Educational programs of TIPO depending on their content and level of training of students are divided into educational programs:

1) providing training of skilled workers of personnel.

Contents of educational programs provide studying of general education, all-humanitarian, all-professional, special disciplines, passing of inservice training and professional practice or studying of the all-humanitarian, all-professional, special disciplines integrated into basic and professional modules, passing of inservice training and professional practice with assignment of working qualifications;

2) providing training of specialists of average link.

Contents of educational programs of TIPO provide studying of general education, social and economic, all-humanitarian, all-professional, special disciplines, passing of inservice training and professional practice or studying of the social and economic, all-humanitarian, all-professional, special disciplines integrated into basic and professional modules, passing of inservice training and professional practice with qualification assignment "the specialist of average link" and (or) working qualifications.

The list of educational programs of TIPO contains in the register of educational programs.

The register of educational programs of TIPO contains in object of informatization in the field of education.

8-2. Educational programs of TIPO for specialties of culture and art are developed taking into account the principle of early professionalizing and features of training of students on the specified specialties. Duration of training depends on complexity of programs and level of the appropriated qualification and is determined by the corresponding state obligatory standard of education.

Educational programs of TIPO for the citizens having the general secondary education provide studying of all-professional, social and economic, special disciplines and accomplishment of the industrial practice works determining future professional activity by the chosen specialty.

Educational programs of TIPO consist of programs of theoretical and inservice training and professional practice.

Educational programs of TIPO with use of dual training provide theoretical training in the organizations of education and at least sixty percent of inservice training, professional practice based on the company (organization).

When training on general education disciplines (to Kazakh and literature - in groups with not Kazakh of training, to Russian and literature - in groups with non-russian language of training, to foreign language, information science, physical culture), laboratory works and practical training on all-humanitarian, all-professional and special disciplines and (or) modules, and also classes in inservice training in workshops (laboratories, on training grounds and in educational farms) which list is determined according to the working curriculum, educational groups are divided into subgroups numbering no more than 13 people.

For persons with special educational needs when carrying out inservice training in workshops (on training grounds and in educational farms) and on practical training educational groups are divided into subgroups numbering no more than 8 people.";

"22-1. The education document of the state sample is issued to the students who passed final assessment in the TIPO organizations.

Education documents of the state sample issue the organizations of formation of TIPO having the license for occupation educational activities for educational programs of TIPO and which underwent the state certification or accreditation in the accreditation bodies entered in the register of acknowledged accreditation bodies.";

state Item 24 in the following edition:

"24. The number of teachers and the list of positions of teachers in the organizations of formation of TIPO realizing educational programs of TIPO are determined according to the subitem 11) of article 4 of the Law "About Education".";

state Item 29 in the following edition:

"29. Educational process in the TIPO organizations realizing educational programs of TIPO includes theoretical training in the organizations of education, and also the inservice training and professional practice which are carried out under the leadership of the training officer, the head of practice in industrial practice workshops, educational farms and on training grounds under the leadership of the mentor, the training officer, the head of practice - based on the companies (organizations).

Types, terms and content of professional practice are determined by working training programs and working curricula.

The organization and carrying out professional practice of the TIPO organization is performed according to the order of the Minister of Education and Science of the Republic of Kazakhstan of January 29, 2016 No. 107 "About approval of Rules of the organization and carrying out professional practice and rules of determination of the companies (organizations) as bases of practice for the organizations of technical and professional, postsecondary education" (it is registered in the Register of state registration of regulatory legal acts at No. 13395).";

"29-1. Dual training is performed according to the agreement on dual training signed on the basis of form of the standard agreement of dual training approved by the order of the Minister of Education and Science of the Republic of Kazakhstan of January 28, 2016 No. 93 "About approval of forms of the standard agreement of rendering educational services for the preschool organizations, the organizations of secondary, technical and professional, postsecondary education, the standard agreement on carrying out professional practice and the standard agreement about dual training for the organizations of technical and professional, postsecondary education" (it is registered in the Register of state registration of regulatory legal acts at No. 13227).

During passing of inservice training and professional practice rules of the labor schedule extend to the trainee.

During passing of inservice training and professional practice the trainee carries out certain functional obligations which are set off in working life of the trainee, and compensation payment during this time can be made.

Requirements for safety and labor protection extend to persons undergoing inservice training and professional practice.

On the basis of the agreement on dual training the company (organization) assigns to the mentor's student for implementation of management of inservice training and professional practice.

The organization of educational process for dulny training is performed according to the order of the Minister of Education and Science of the Republic of Kazakhstan of January 21, 2016 No. 50 "About approval of Rules of the organization of dual training" (it is registered in the Register of state registration of regulatory legal acts at No. 13422).

29-2. The organizations of formation of TIPO realizing educational programs of TIPO in form of business of the state companies on the right of economic maintaining or operational management represent on paid basis with the conclusion of the agreement on rendering paid services the following goods (works, services) over requirements of the state obligatory standards of education in compliance subitem 3-2) of article 63 of the Law "About Education".";

"35. The state control in the TIPO organizations is exercised in agrees article 59 of the Law "About Education".

36. Teachers of the organizations of formation of TIPO realizing educational programs of TIPO undergo annually physical examinations according to the order of the deputy. The Minister of Health of the Republic of Kazakhstan of October 15, 2020 No. KR DSM-131/2020 "About approval of target groups of persons which are subject to obligatory medical examinations and also rules and frequency of their carrying out, amount of laboratory and functional researches, medical contraindications, the list of harmful and (or) dangerous production factors, professions and works in case of which accomplishment preliminary obligatory medical examinations in case of revenues to work and periodic obligatory medical examinations are performed and rules of rendering the state service "Passing of Preliminary Obligatory Medical Examinations"" (it is registered in the Register of state registration of regulatory legal acts at No. 21443).";

Distance training is performed in the TIPO organizations according to the order of the Minister of Education and Science of the Republic of Kazakhstan of March 20, 2015 No. 137 "About approval of requirements to the organizations of education for provision of distance training and rules of the organization of educational process for distance training" (it is registered in the Register of state registration of regulatory legal acts at No. 10768).";

"41. The organization of formation of TIPO, the implementing educational programs of TIPO appropriate to students workers of qualifications, qualifications "the specialist of average link".";

The organizations of formation of TIPO realizing educational programs of TIPO provide implementation of acceptance of students in the TIPO organizations taking into account the short-term, mid-term forecast of need for personnel for industries of national economy, requirement of the regional labor market by demanded specialties.".

1) the highest college - the educational institution realizing the integrated modular educational programs of general secondary, technical and professional, postsecondary education;

2) dual training - form of the training combining training in the organization of education with the obligatory periods of inservice training and professional practice at the company (in the organization) with provision of workplaces and compensation payment to students in case of equal responsibility of the company (organization), educational institution and the student;

3) school - the educational institution realizing educational programs of the main average, general secondary, technical and professional or postsecondary education in the field of culture;

4) applied bachelor degree - postsecondary education which educational programs are directed to training with qualification award "the applied bachelor";

5) the applied bachelor - the qualification awarded to persons who mastered educational programs of postsecondary education.";

"2. Educational programs ON are directed to training of applied bachelors from among the citizens having secondary education (general average or technical and professional).

Educational programs ON are implemented in the highest colleges or schools according to article 33 of the Law "About Education".

3. Tasks of the PO organizations are:

1) creation of necessary conditions for receipt of the quality education directed to forming, development and professional formation of the personality on the basis of national and universal values, achievements of science and practice;

2) development of creative, spiritual and physical capacities of the personality, forming of strong bases of morality and healthy lifestyle, enrichment of intelligence by creation of conditions for identity development;

For carrying out professional practice of the PO organization, the implementing educational programs ON, on contractual basis (except the organization of formation of the Ministry of Defence of the Republic of Kazakhstan) determine the companies (organization) as bases the practician, approve the working training programs and schedules of passing of professional practice approved with them.

In agreements obligations and responsibility of the PO organizations, companies (organizations) which are bases of practice and students are determined.

Costs for professional practice are provided by the PO organizations and the companies (organizations) which are bases of practice and are determined by the signed agreements.

state Item 19 in the following edition:

"19. The staff list is determined by OVPO and annually affirms his head (executive body).

In OVPO created in the form of the NAO, the staff list affirms executive body within the approved number of staff the board of directors according to Item 9-2 of article 44 of the Law "About Education".

In ВСУЗах the staff list is determined by the relevant authorized state body.";

state Item 24 in the following edition:

"24. Develops for implementation of acceptance of the studying OVPO, claims and provides observance of Regulations of Admission in OVPO developed on the basis of the Standard Regulations of Admission to training in the organizations of education realizing educational programs of the higher and postgraduate education approved according to the subitem 11) of article 5 of the Law "About Education".

Acceptance of students in ВСУЗы is performed according to Regulations of Admission to training in the military, special educational institutions realizing the educational programs of appropriate level approved according to the subitem 9) of article 5-1 of the Law "About Education".

OVPO provides acceptance, transfer and recoveries studying in unified information system of formation of authorized body in the field of education with attachment of the relevant documents.

OVPO after issue of education documents to graduates within a month enters this educated into unified information system of authorized body in the field of education.

Series of education documents of own sample for graduates of OVPO issued since 2021 affirm authorized body as the field of education. The number generation and QR codes is performed by means of the special service provided by authorized body in the field of education.

OVPO provides functioning of electronic system according to the issued education documents and creates electronic base (archive) of the education documents including which are earlier issued.";

state Item 25 in the following edition:

"25. The amount of payment for training in educational programs of the higher and (or) postgraduate education and form of the agreement of rendering educational services affirms OVPO.

The amount of payment and data on payment of the studying OVPO enters into unified information system formations of authorized body in the field of education.

In OVPO created in the form of the NAO, approval of the amount of payment for training in educational programs of the higher and (or) postgraduate education is within the exclusive competence of the board of directors.";

state Item 31 in the following edition:

"31. OVPO develops, claims and provides observance of translation rules and recovery of the these rules studying according to regulations.

At the same time, transfer and recovery of students from one educational program on another, from one OVPO in another is performed in the period of summer and winter vacation.

The student is translated or recovered in any OVPO irrespective of assignment terms in case of recovery, except for the organizations of education in case of the President of the Republic of Kazakhstan and ВСУЗов.

In case of decision making by authorized body about suspension, response and deprivation of the license and (or) appendix to the license for occupation educational activities, the student of this OVPO is transferred to other OVPO for continuation of training during the current semester from the date of decision making by authorized body about suspension, response and deprivation of the license and (or) appendix to the license.

In case of the voluntary termination of the license and (or) appendix to the license for occupation educational activities or liquidations of OVPO, the student of this OVPO is transferred to other OVPO for continuation of training during the current semester from the date of voluntary return of OVPO about the termination of the license and (or) appendix to the license or liquidation of OVPO.

In case of suspension, response or expiration of accreditation, except for the organizations of education in case of the President of the Republic of Kazakhstan and ВСУЗов, the student of this OVPO is transferred to other OVPO for training continuation from the date of decision making about suspension, response or expiration of accreditation in a month.

The studying OVPO is translated or recovered after assignment if they completely completed the first academic period of the mastered program according to the individual curriculum.

Transfer of the student from paid basis of training on training in the state educational order is made according to the procedure, approved according to the subitem 5) of article 4 of the Law "About Education".

The student studying according to the educational grant at will is transferred with preserving the educational grant to other OVPO.

In case of transfer of the student the accepting OVPO considers the direction of preparation, profile of the educational program, educational achievements, and also cases of violation of the academic honesty by the student.

In case of transfer or recovery of the results of training of OVPO studying for reoffsetting the relevant commission is created.

Transfer or recovery of students, except for the organizations of education in case of the President of the Republic of Kazakhstan and ВСУЗов, is performed in the OVPO having the license and (or) appendix to the license for occupation educational activities, and also having the international specialized accreditation of the national and (or) foreign accreditation authorities included in registers and (or) associations of accreditation bodies of state members of Organization for Economic Cooperation and Development (OECD) on the field of education.

In case of decision making by authorized body about suspension, response and deprivation of the license and (or) appendix to the license for occupation educational activities, the voluntary termination of the license and (or) appendix to the license for occupation educational activities or liquidations of OVPO, suspension, response or expiration of accreditation transfer and recovery of students in this OVPO is not performed.

The students who arrived according to the educational grants approved for separate OVPO and also on pedagogical specialties within allocated quota are transferred to other OVPO only on paid basis.

Transfer of students, undergraduates, listeners and residency from other OVPO in national OVPO or other OVPO is performed on condition of surcharge by students of difference of cost of the educational grant.

Transfer of the established threshold point studying from groups of the educational programs of the higher education requiring creative preparation on other groups of educational programs is performed in the presence of the certificate of single national testing with point not below according to the Standard Regulations of Admission to training in the organization of education realizing educational programs of the higher and postgraduate education, approved by the order of the Minister of Education and Science of the Republic of Kazakhstan of October 31, 2018 No. 600 (it is registered in the Register of state registration of regulatory legal acts for No. 17650).

Transfer of the higher education studying from other groups of educational programs, on educational programs of the pedagogical direction is performed in the presence of the certificate of single national testing with point not below the established threshold point according to the Standard Regulations of Admission to training in the organization of education realizing educational programs of the higher and postgraduate education, approved by the order of the Minister of Education and Science of the Republic of Kazakhstan of October 31, 2018 No. 600 (it is registered in the Register of state registration of regulatory legal acts for No. 17650).

Chapter 1. General provisions

1. 6. The main structural unit of the preschool organization is the age group which is completed by the even-aged or uneven-aged principle.

7. Fullness of age groupes by the even-aged principle:

1) group of early age (of 1 year) - no more than 10 children;

2) younger group (of 2 years) - no more than 20 children;

3) average group (of 3 years) - no more than 25 children;

4) the senior group (of 4 years) - no more than 25 children;

5) group (class) of preschool preparation (of 5 years) - no more than 25 children.

8. Fullness of age groupes by the uneven-aged principle:

1) in the presence in group of children of two age (of 1 year, of 2 years) - no more than 15 children;

2) in the presence in group of children of three age (of 3 years, of 4 years, of 5 years) - no more than 20 children.

9. 10. In the preschool organizations education and training of pupils with special educational needs taking into account interests of parents (legal representatives) is provided:
