About introduction of amendments to the Law on management of public property and its privatization No. 121/2007

The Parliament adopts this organic law.

Art. I. - In the Law on management of public property and its privatization No. 121/2007 (Official monitor of the Republic of Moldova, 2007, Art. No. 90-93, 401), with subsequent changes, to make the following changes:

1. Part (Article 17 to state 5) in the following edition:

"(5) the Employment contract of idle assets of the state/municipal companies and commercial societies with completely or mainly public capital, the objects which are not included in lists, not privatizeable, except for assets as a part of industrial parks, can be concluded for a period of one year up to three years.".

2. In part (6) Article 18 the last offer to state in the following edition:

"The specified parcels of land are subject to privatization in stipulated in Clause 54th procedure.".

3. In Article 22:

Item c) parts (to state 1) in the following edition:

"c) non-residential premises;";

add Article with part (1-1) following contents:

"(1-1) cannot be subject to privatization:

a) non-residential premises in buildings in which bodies of the public power, the state/municipal companies, the organizations and/or organizations, except for the rooms which are in cellars or on the first floors of the respective buildings are located if placement of social facilities for them, and also except for the rooms located in cellars or on technical floors is provided in the project documentation or documents of technical inventory count if they are not intended for placement of structural elements of objects of technical infrastructure;

b) the real estate which is national cultural property, except for permitted to sale/purchase according to the legislation;

c) real estate on which decisions on demolition according to the master plan of development of the settlement are made;

d) the rooms located in protective zones of objects of technical infrastructure, in underground crosswalks, and also in other places public;

e) rooms in which structural elements of objects of technical infrastructure are located;
