"8. Payment of the consular fees and charges on account of compensation of the actual expenses connected with making of consular actions is performed before submission of documents on making of consular action.
9. Paid amounts of the consular fees and charges on account of compensation of the actual expenses connected with making of consular actions are subject to return partially in case of payment of the specified charges in bigger size, than it is provided by the rates of the consular fees established by the Government of the Russian Federation, and the rates of charges established according to part 3 of this Article.
10. Paid amounts of the consular fees and charges on account of compensation of the actual expenses connected with making of consular actions are subject to return completely in case:
1) the address of the payer of the specified charges (further - the payer) to the authorized consular official with request not to make consular action in connection with which the specified charges, or returns of the statement for making of consular action and (or) documents without their consideration by the authorized consular official were paid earlier;
2) refusal of the authorized consular official in making of notarial action;
3) refusal in issue of the passport of the citizen of the Russian Federation proving the identity of the citizen of the Russian Federation outside the territory of the Russian Federation including containing the electronic medium of information.
