THE RESOLUTION OF THE NATIONAL AGENCY ON REGULATION IN POWER INDUSTRY OF THE REPUBLIC OF MOLDOVA

About introduction of amendments to the Code of networks of natural gas approved by the Resolution of the NARE Administrative board No. 420/2019 of November 22, 2019

Based on the Art. 8, h (1) the item g), Art. 67 of h (4) the Natural Gas Act No. 108/2016 (2016, No. 193 - 203, the Art. 415), with subsequent changes, the Administrative board of the National agency on regulation in power decides the official monitor of the Republic of Moldova:

1. In the code of networks of natural gas approved by the Resolution of Administrative board of the National agency on regulation in power No. 420/2019 (The official monitor of the Republic of Moldova, 2020, No. 14 - 23, to the Art. 60) registered in the Ministry of Justice at No. 1520 of January 3, 2020 to make the following changes:

Item on harmonization to add 1) with words:

"and Regulations of the Commission of March 26, 2014 about establishment of the network code on balancing of the gas in gas transmission networks published in the Official magazine of the European Union (JO) No. L91 of the March 27, 2014 accepted by the Solution No. 2019/01/PHLG-EnC of the Standing group of high level of Energy community of December 12, 2019 about adoption of Regulations (EU) No. 312/2014 of the Commission of March 26, 2014 about establishment of the network code on balancing of gas in gas transmission networks.";

Item 5 to add 2) with the following terms in alphabetical order:

the balancing action - the measures taken by ORS for ensuring balance in system of natural gas by change of the flows of natural gas arriving or actions accepted from network of transfer of natural gas, except for with natural gas which is not specified as taken from system, and the natural gas used by ORS for system operation;

the declared quantity - amount of the natural gas transferred between ORS and one or several users of system or, if necessary, between balancing portfolio;

daily measurement - measurement of amount of natural gas and information collection about the measured amount of natural gas once in gas day;

not daily measurement - measurement of amount of natural gas and information collection about the measured amount of natural gas at least two times in gas day;

daily obligations - set governed, for users of system on ensuring balance between amount of the natural gas arriving and quitting the system of the natural gas belonging to users of system in one gas day;

the participant of the transaction - the user of system or the signed contract with the operator of trade platform and satisfying necessary conditions for carrying out transactions in trade platform;

intra day payment - the received payment or the payment made by ORS from or to the user of system as a result of the intra day obligation;

payment for daily imbalance - payment which the party responsible for balancing (further - SOB), will pay or receive for the amount of daily imbalance;

payment for balancing neutrality - the payment equal to difference between the amounts received or which are subject to obtaining and the amounts paid or which are subject to payment of ORS as a result of realization of the balancing actions which are paid or which can be collected from users of system;

trade platform - the electronic platform provided and managed by the operator of trade platform by means of which bidders can place and accept including the right to the changes and cancellations, requests for purchase/sale of natural gas necessary for response to the short-term fluctuations in demand or offers of natural gas, in accordance with the terms, applicable to trade platform according to which ORS carries out transactions with the purpose of accomplishment of the balancing actions;

balancing platform - trade platform in which ORS participates in all transactions;

balancing portfolio - group of the entrances and exits belonging to one user of system;

localization product - the flexible product of natural gas sold for delivery to certain place in balancing zone;

temporary product - the flexible product of natural gas sold for delivery during the certain period of time during balancing;

the basic scenario - model of provision of information according to which information on not daily measured exits consists of forecasts next day and for the present day;

balancing service - the service provided to ORS on contractual basis necessary for covering of the short-term fluctuations in demand or the offer of natural gas which is not the short-term standardized product (STSP);

option 1 - model of provision of information according to which information on the daily and not daily measured exits is based on distribution of the measured flows during the day;

option 2 - model of provision of information according to which information on not daily exits is the forecast next day;

balancing zone - system of input-output to which certain mode of balancing is applied and which can include systems of distribution or their part.

"The list of points of entry and exit changes the resolution of the Agency. ORS publishes lists of points of entry and exit on the electronic page within one working day from the date of receipt of the relevant resolution."

7) In the Section V, Chapter I to make changes to the name of part 2 and to state in the following edition:

"Transportation services of natural gas, other services than those on transportation and rates for them".

8) In Item 321 of the word: "the additional service" to replace with words: "other service than in transportation".

"The income from provision of other services than on transportation is compensated by other rates, excellent from transport, applicable for specific service which is not transport service. These rates shall:
