At the same time the actual tutor who reached age of 50 and 55 years (respectively the woman and the man) or being the disabled person has the right to the monthly monetary compensation established by parts 9 and 10 of this Article. Recognition of person by the actual tutor is made by court according to the procedure of special proceeding on cases on establishment of the facts having legal value.".
