About modification of some legal acts of Ukraine in connection with adoption of law of Ukraine "About prevention of corruption"

The Verkhovna Rada of Ukraine decides:

I. Make changes to such legal acts of Ukraine:

1. In the Labor code of Ukraine (The sheet of the Verkhovna Rada of USSR, 1971, appendix to No. 50, the Art. 375):

Article 32 to add 1) with part six of such content:

"The worker who reported about the possible facts of the corruption or connected with corruption offenses, other violations of the law of Ukraine "About prevention of corruption", made by other person cannot be dismissed or forced to dismissal, is brought to disciplinary responsibility in connection with such message or will subject to other negative corrective actions, or threat of such corrective actions. Unmaskers of corruption have also other rights and guarantees of protection established by the Law of Ukraine "About prevention of corruption";

Part one of Article 41 to add 2) with Item 4-1 of the following content:

"4-1) availabilities at the worker of real or potential conflict of interest which has permanent nature and cannot be settled by the different way provided by the Law of Ukraine "About prevention of corruption".

2. In the Code of civil protection of Ukraine (The sheet of the Verkhovna Rada of Ukraine, 2013, Art. No. 34-35, 458):

"The law of Ukraine "On the principles of prevention and anti-corruption" shall be replaced with words 1) in part five of Article 101 of the word "the Law of Ukraine "On prevention of corruption";

2) in Article 102:

in word part four of "corruption offense" shall be replaced with words "the offense connected with corruption";

add with part five and the note of the following content:

"5. Candidates for acceptance for service of civil protection before position assignment shall report to management of body in which for position they apply, about persons close to them working in such body.

Note. The term "close persons" is used in this Code in the value given in the Law of Ukraine "About prevention of corruption";

3) in Article 106:

in part two:

in Item 10 "direct" to replace the word with the word "direct";

add with Item 10-1 of the following content:

add with the note of the following content:

"Note. The term "direct subordination" in this Code is used in the value given in the Law of Ukraine "About prevention of corruption";

4) in part four of Article 107 of the word "according to the procedure, established by the Law of Ukraine "About the principles of prevention and anti-corruption" shall be replaced with words "according to the procedure, established by the Law of Ukraine "About prevention of corruption";

5) in Article 129:

in part twenty sixth "direct" to replace the word with the word "direct";

in part twenty eighth of the word "the administrative corruption offense connected with violation of the restrictions provided by the Law of Ukraine "About the principles of prevention and anti-corruption" shall be replaced with words "the administrative offense connected with corruption".

3. In the Criminal code of Ukraine (The sheet of the Verkhovna Rada of Ukraine, 2001, Art. No. 25-26, 131):

1) in the note to article 45 of figure "368 - 369-2" to replace with figures "368, 368-3 - 369, 369-2, 369-3";

2) in Article 369-2:

the paragraph one of part one to add with the words "or local self-government";

the paragraph one of part two, paragraph one of part three after the words "accomplishment of functions of the state" to add with the words "or local self-government";

state the note in the following edition:

"Note. Persons authorized on accomplishment of functions of the state or local self-government are persons determined in Item 1, the subitem "an" of Item 2 parts one of article 3 of the Law of Ukraine "About prevention of corruption" and also the officials determined in part four of article 18 of this Code".

4. In the Law of Ukraine "About prevention of corruption" (Sheets of the Verkhovna Rada of Ukraine, 2014, No. 49, Art. 2056 with subsequent changes):

1) in Article 3 part one:

in Item 1:

in the subitem "an" of the word "member of council of the National Bank of Ukraine" to exclude;

"ї" to state the subitem in the following edition:

"ї) Head of Office of the President of Ukraine, his First deputy and deputies, advisers, assistants, representatives, press secretary of the President of Ukraine, assistants to judges";

The second parts four of Article 13-1 of the word and figure "Article 53 part three" shall be replaced with words 3) in the paragraph also in figures "parts one and third Article 53-4";

The paragraph of the sixth part one of Article 19 to state 4) in the following edition:

"Anti-corruption programs and changes in them are subject to approval of the National agency in the procedure determined by it";

5) in the subitem "an" of item 4 of part two of Article 20:

shall be replaced with words words of "corruptogenic factors" "corruption risks", and the word of "the specified factors" - words of "the specified risks";

In paragraphs one and the second parts one of Article 27 of the word and figure "subitems "a", "v" - "з" Item 1" to replace 6) with the word and figure "Item 1";

7) in Article 46:

third Item of 1 part one after the word "competitive" to add the paragraph with words "disciplinary";

in the note to Article of the word of "this Law" shall be replaced with words also in figure "taking into account provisions of article 1 of this Law", and the word "children" - words "minor children as of the last day of the accounting period";
