About modification and amendments in the Civil code of Turkmenistan
I. Bring in the Civil code of Turkmenistan approved by the Law of Turkmenistan of July 17, 1998 (Sheets of Majlis of Turkmenistan, 1998, No. 2, Art. 39; 2003, No. 4, Art. 36; 2007, No. 1, Art. 40), following changes and amendments:
1. Add with article 206-1 of the following content:
"Article 206-1. Acquisition of property right to immovable ownerless thing
1. The immovable thing which has no owner is ownerless, or the owner of which is unknown.
2. Ownerless immovable thing according to the statement of body of the local executive authority in the territory of which it is, accepted on accounting by the state body performing registration of the right to real estate.
After year from the date of statement of ownerless immovable thing on accounting body, authorized to manage property of the local executive authority and in the territory of which it is, can take a legal action with the statement for recognition of real estate ownerless and its transfer to state-owned property".
2. State Article 736 in the following edition:
"Article 736. Concept
1. According to the trust management agreement the owner (one party) gives to certain term to the trustee (other party) personal or real estate or the rights to it to trust management, and other party accepts them and shall exercise control of them for the benefit of the owner.
2. The cession of property in trust management does not attract transition of the property right to it to the trustee".
3. To state part one of Article 737 in the following edition:
"1. The trustee shall dispose of fiduciary property on its own behalf, but due to risk and expenses of the principal of property. At the same time concerning real estate rules according to which the relations connected with its alienation shall be approved with the owner are effective".
4. State Article 739 in the following edition:
