About entering of amendments and changes into the Order of the Ministry of Finance No. 105 of July 28, 2016 about approval of some forms concerning change of repayment period of the tax liability by delay or payment by installments
For the purpose of ensuring proper tax administration, as well as for the purpose of observance of provisions of litas. j) article 11 of the Executive code I ORDER:
1. In appendix No. 2 to the Order of the Ministry of Finance No. 105 of July 28, 2016 after the text to add "the AGREEMENT of pledge" with the word "/mortgage" and from the new paragraph the text "the NOTARIAL ACT ALLOCATED with EXECUTIVE FORCE".
2. To add appendix No. 2 to the Order of the Ministry of Finance No. 105 of July 28, 2016 with new Item of 161 following contents "According to this agreement, the Parties agreed about investment with its executive force.
Owing to investment of the Agreement with executive force the Pawnbroker of pledge/mortgage performs the mortgage right forcibly, according to this agreement, without submission to court of the statement for receipt of the resolution or the judgment.
According to this agreement allocated with executive force, the mortgage right can be performed according to provisions of the current legislation.
Agreement parties approved under the mutual agreement that this agreement will be allocated with executive force, and knowing about effects, declared in the presence of the notary that they are in senses (are capable) and have no diseases which interfere with understanding of basic provisions of the signed document, and also about lack of any circumstances which promote the conclusion of this transaction in extremely disadvantageous conditions for the parties".
3. This order becomes effective from the date of publication in Monitorul Oficial al Republicii Moldova.
