About modification and amendments in the order of the acting minister on investments and development of the Republic of Kazakhstan of July 28, 2017 No. 509 "About approval of Rules of production of flights in civil aviation of the Republic of Kazakhstan" and in the order of the acting minister of transport and communications of the Republic of Kazakhstan of May 16, 2011 No. 279 "About approval of the Instruction on the organization and servicing of air traffic"
I ORDER:
1. Bring in the order of the acting minister of transport and communications of the Republic of Kazakhstan of July 28, 2017 No. 509 "About approval of Rules of production of flights in civil aviation of the Republic of Kazakhstan" (it is registered in the Register of state registration of regulatory legal acts for No. 15852, it is published on March 29, 2018 in Reference control bank of regulatory legal acts of the Republic of Kazakhstan) the following changes and amendments:
in Rules of production of flights, the approved specified order:
in Item 2:
84) to state the subitem in the following edition:
"84) difficult weather conditions - conditions under which meteorological visibility makes 2000 meters and less and (or) height of the lower bound of clouds of 200 meters (650 feet) and below in case of their total quantity more than two octants;";
add with subitems 188) and 189) of the following content:
"188) zone of airfield movement - the airspace of certain sizes around airfield established for safety of airfield movement;
189) dispatching zone - the controlled airspace stretching up from the land surface to the established upper bound;";
state Item 190 in the following edition:
"190. All airplanes onboard which transportation more than 19 passengers is resolved are equipped with at least one automatic emergency drive transmitter of the KOSPAS system - CAPCAT (ELT) or two ELT of any type, except for airplanes which individual certificates of the flight validity are for the first time issued after July 1, 2008 which are equipped at least two ELT, one of which is automatic, or, to transfer to at least one ELT having functionality every minute in the autonomous mode information based on which the operator can determine their location if they are in distress.
All airplanes onboard which transportation of 19 or less passengers is resolved are equipped with at least one ELT of any type for determination of location, tracking and the notification on emergency), except for airplanes individual certificates of the flight validity of which are for the first time issued after July 1, 2008 which are equipped with at least one automatic ELT.
All helicopters with the maximum certified take-off weight over 3180 kilograms, the carrying-out commercial air transportations, are equipped with at least one automatic emergency drive transmitter of the KOSPAS system - CAPCAT (ELT), and in case of accomplishment of flights over water space, at least one automatic ELT and one ELT(S) on the liferaft or life jacket.
Airplanes with the maximum certified take-off weight less than 2250 kilograms are equipped with at least one portable GPS beacon (SPOT Satellite GPS Messenger) of any type for determination of location, tracking and the notification on emergency.
All airplanes with the maximum certified take-off weight less than 5700 kilograms and all helicopters which are not carrying out commercial air transportations are equipped with at least one portable GPS beacon (SPOT Satellite GPS Messenger) for determination of location, tracking and the notification on emergency of any type.";
state Item 382 in the following edition:
"382. Aircrafts (further - AF) do not carry out formation flyings unless there is preliminary arrangement between crews of the separate AF entering into group, and formation flyings in controlled airspace are carried out as general air traffic under following conditions:
1) the group carries out flight as one AF from the point of view of navigation and submission of reports on location;
2) between AF in group are responsible for ensuring echeloning the commander of crew of the leading AF and commanders of crews of other AF of group, and at its providing are considered transition periods when AF is maneuvered for occupations of the place in group, and also during convergence and discrepancies;
3) everyone AF is from the leading AF at a distance of no more than 1 kilometer (0,5 nautical miles) in the side and longitudinal planes and 30 meters (100 feet) in the vertical plane.";
add with Items 382-1, 382-2, 382-3. 382-4, 382-5, 382-6, 382-7, 382-8 and 382-9 following contents:
"382-1. In case of accomplishment of formation flying of AF participating in general air traffic, provision of flight plan is performed by the commander of crew of the leading AF according to Appendix 6 to Rules of use of airspace of the Republic of Kazakhstan, approved by the order of the Government of the Republic of Kazakhstan of May 12, 2011 No. 506 "About approval of Rules of use of airspace of the Republic of Kazakhstan and modification of the order of the Government of the Republic of Kazakhstan of December 31, 2010 No. 1525 and about recognition voided some decisions of the Government of the Republic of Kazakhstan" (further - Rules IVP).
382-2. The commander of crew of the leading AF is responsible for preflight instructing of the crews of AF which are carrying out flight as a part of group and establishes procedures for each crew of AF of formation flying:
1) in case of departure;
2) when landing;
3) when flying with punching of cloudiness in the course of enrollment and decrease;
4) when flying along route;
5) in case of the situations requiring application of emergency procedures;
6) in case of situations when formation flying cannot be continued.
382-3. The commander of crew of the leading AF makes the decision on accomplishment of formation flying on PVP or PPP, taking into account weather conditions.
382-4. In case of entrance to zone of responsibility of body of Department of Internal Affairs, crew of the leading AF the quantity of AF in group reports on body of Department of Internal Affairs. The appointed VORL code is assigned by body of Department of Internal Affairs for the leading AF, other AF in group keeps this code in the Stand by mode if other instructions are not received from body of Department of Internal Affairs and crews of AF perform listening of working frequency of body of Department of Internal Affairs.
382-5. Rise of AF in case of accomplishment of formation flyings is performed in group, except as specified, when the commander of the leading AF asks to provide Department of Internal Affairs separately for each AF. Landing of AF in case of accomplishment of formation flyings is performed with observance of the established echeloning intervals. The place and/or time of convergence/discrepancy of the AF group, the planned airspace occupation across and/or verticals is determined by the commander of the leading AF and beforehand reported to body of Department of Internal Affairs. The body of Department of Internal Affairs according to air situation can prohibit discrepancy of group or limit the occupied airspace in case of group discrepancy.
382-6. When flying on PPP the discrepancy of the AF group is carried out only on permission of body of Department of Internal Affairs. The commander of crew of the leading AF provides echeloning between AF in case of group discrepancy until when instructions of body of Department of Internal Affairs are followed, the established echeloning intervals are properly identified and provided to AF. In this case, each crew of AF establishes the VORL code assigned for it and contacts body of Department of Internal Affairs, using the registration number.
382-7. When flying on PPP the convergence of the AF group is carried out only on permission of body of Department of Internal Affairs. After permission of body of Department of Internal Affairs and the report of the commander of the leading AF on the beginning of convergence in the AF group, the commander of the leading AF provides echeloning between AF, carrying out formation flying. Conducting AF keeps the appointed VORL code, and other AF in group keeps this code in the Stand by mode if other instructions are not received from body of Department of Internal Affairs.
382-8. In case of accomplishment of flights on PVP observance of intervals of echeloning between AF groups in case of convergence/discrepancy provide crews of AF of group.
382-9. Accomplishment of the formation flyings of AF of the state aircraft participating in operational air traffic is performed by introduction in airspace of the temporary mode or short-term restrictions.";

"418 Flights on PVP are carried out in visibility conditions and at distance to the clouds equal or exceeding the sizes specified in the table 1 of appendix 14 to these rules, and height of 3050 meters (10000 feet) over average sea level with instrument speed no more than 463 kilometers per hour (250 nodes) are lower:
1) in the afternoon;
2) in twilight - when flying on airfields (airfields) equipped with lighting means or with matching of airfields from air and on airfields (platforms) not equipped with lighting means not earlier than in 30 minutes after approach of dawn and not later than 30 minutes before dark;
During the period between calling and sunrise only SPVP according to requirements of paragraph 6 of Chapter 7 of these rules is allowed to carry out 3).";

In the absence of other instructions in dispatching permissions of body of Department of Internal Affairs horizontal cruiser flights on PVP at the height more than 900 meters (3000 feet) over terrestrial or surface of the water or above, the Republic of Kazakhstan published in AIP or other collection of aeronautical information are carried out on cruiser echelon, taking into account the direction of the line of way, according to the scheme of distribution of echelons of flight provided in the Instruction on the organization and servicing of air traffic approved by the order of the acting minister of transport and communications of the Republic of Kazakhstan of May 16, 2011 No. 279 (it is registered in the Register of state registration of regulatory legal acts for No. 7006) (further - the Instruction).";

"427. PVP provide:
1) keeping of the established intervals of echeloning or ensuring independent echeloning between AF in compliance with the dispatching permission depending on the applied airspace class, and also between AF and material objects in air by visual observation by crew of AF of air situation;
2) keeping of true safe height and bypass of artificial obstacles by means of visual observation of the area located ahead;
3) is weeded by AF within the airway, route of flight, the scheme of flight around airfield (helidrome) by method of visual orientation with use of the available navigation aids;
4) in controlled airspace - in addition permanent listening of the relevant channel of speech communication "air - the earth" body of Department of Internal Affairs in which zone of responsibility there is AF and, during the period between 20 and 40 minutes after time of the last session of radio communication, reports on location of AF are transferred if the body of Department of Internal Affairs under control of which there is AF did not establish other interval of time;
5) in uncontrollable airspace - in addition permanent listening of ether (working radio frequency).
In case of accomplishment of flights of AF on PVP at small heights transfer of the report on location of AF on any means of communication, available at the commander of AF is allowed.";

"436. Upon transition from flight on PVP on accomplishment of flight on SPVP or on PPP in case of accomplishment of flight in dispatching zone the commander of crew of AF approves the actions and echelon (height) of flight with body of Department of Internal Affairs which provides the established echeloning intervals between AF.";

"446. In the absence of radio station onboard AF flight on PVP is not carried out at the heights over 50 meters (170 feet), the flight zones except for allocated.
447. When flying for the purpose of accomplishment search and rescue and wrecking, flights of sanitary aircraft for rendering the emergency medical care, especially important flights, distillations of AF are applied to accomplishment of especially important flights and training flights by SPVP day and night.
In the mountain area of SPVP are not carried out at night.";

"449. SPVP provide:
1) piloting of AF in the area of the natural horizon with simultaneous control on devices of its space provision;
2) accomplishment of flight with observance of intervals of the horizontal echeloning established for PPP;
3) keeping of the set echelon (height) of flight taking into account artificial obstacles;
4) determination of the place of AF visually on land reference points with use of the available navigation aids;
5) availability of control of body of Department of Internal Affairs (Department of Internal Affairs) of observance of intervals between AF using RTS.
450. SPVP are carried out in dispatching zone on AF with the maximum speed of flight no more than 300 kilometers per hour (160 nodes) for the following types of flights:
1) in the afternoon - for lack of meteoconditions for flights on PVP in case of accomplishment of flights of sanitary aircraft for rendering the emergency medical care, search and rescue and wrecking, especially important flights;
2) at night - in case of accomplishment of flights of sanitary aircraft for rendering the emergency medical care, search and rescue and wrecking, especially important flights;
3) day and night - in case of accomplishment of training flights.";

"453. SPVP are carried out in the presence of communication between body of Department of Internal Affairs and AF on condition of providing the established echeloning intervals on PPP.";

"453-1. Echeloning of all AF who is carrying out special flights on PVP is performed according to the echeloning minima given in the Instruction and when it is offered by the Department of Internal Affairs relevant organ, between all AF who is carrying out special flights on PVP according to the echeloning minima established by body of Department of Internal Affairs.";

"457. In case of accomplishment of flight on SPVP change of height (echelon) of flight is made after permission of body of Department of Internal Affairs under which direct management there is AF in dispatching zones.";

"459. Flights on PPP are carried out:
1) in controlled airspace of class "A", "B" and "C" - without restriction of instrument speed;
2) in airspace of the class "D", "E" and "G" - with restriction of the instrument speed of 463 kilometers per hour (250 nodes) is lower than 3050 meters (10000 feet) over the average level of the sea;
3) when flying using the equipment imitating visibility.";

"462. Flights on PPP in controlled airspace are carried out on the set cruiser echelons of flight in case of strict keeping of the set mode of flight and route of Department of Internal Affairs according to requirements of the Rules IVP concerning vertical, horizontal echeloning.
463. Flight on PPP in is uncontrollable airspace of class G is carried out on cruiser echelon taking into account the direction of the line of way, according to the scheme of distribution of echelons of flight provided in the Instruction unless the body of Department of Internal Affairs this other instructions for flights at the height of 900 meters (3000 feet) or is lower over the average level of the sea.";

"468. The dispatcher of the Department of Internal Affairs relevant organ under control of which flight of AF on PPP is carried out:
1) correctly appoints echelons (heights) of flight;
2) provides the established intervals of vertical, horizontal echeloning;
3) exercises control of keeping of AF of route of flight, the scheme of exit from the dispatching area (zone), decrease and landing approach in the presence of radar control (further - RLK);
4) timely and authentically provides to crew of AF information on weather conditions, on variations from the set flight trajectory in the presence of RLK and, if necessary, about air and ornithological situation;
5) transfers to crews of AF reasonable instructions and recommendations.";

In case of flight of AF along route at height heights of transition and need of occupation of echelon are lower, transfer of scale of pressure of the barometric altimeter from the minimum pressure along route specified to the average level of the sea upon standard atmospheric pressure is performed when crossing height of transition for echelon occupation.

In case of decrease in AF from flight echelon up to the flight altitude along route at transition height below, transfer of scale of pressure of the barometric altimeter from the standard atmospheric pressure upon the minimum pressure along route specified to the average level of the sea is performed:

496. When landing in airfield transfer of scale of pressure of the barometric altimeter is made:
1) from value 1013, gpa ((((760 mm Hg) on QNH value when crossing echelon of transition;
2) when approaching to airfield at transition height below from the minimum atmospheric pressure along route specified to the average level of the sea upon QNH value - at the established boundary or on specifying of body of Department of Internal Affairs.
QFE value is transferred at the request of crew of AF only for control of flight altitude by it.";

"502. In case of safety hazard of flight on the set echelon (meeting with the dangerous meteorological phenomena, failure of the aircraft equipment) the commander of crew of AF independently changes echelon (height) with the immediate report on it body of Department of Internal Affairs.

547-6. In case of refusal bonds the crew of AF continues flight along RNAV route according to established procedure of actions on communication loss case.";
