About modification and amendments in some orders of the Ministry for Investments and Development of the Republic of Kazakhstan

I ORDER:

1. Approve the enclosed list of some orders of the Ministry for Investments and Development of the Republic of Kazakhstan to which changes and additions are made.

2. To provide to committee of transport of the Ministry for Investments and Development of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy on paper and electronically in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) within ten calendar days after state registration of this order the direction it the copy on official publication in periodic printing editions;

4) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan;

5) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of actions, according to subitems 1), 2), 3) and 4) this Item.

3. To impose control of execution of this order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication and extends to the relations which arose since January 1, 2017.

1. In the order of the acting minister on investments and development of the Republic of Kazakhstan of February 24, 2015 No. 166 "About approval of Rules of long-term subsidizing of the expenses of carrier connected with implementation of transportations of passengers according to socially important messages" (registered in the Register of state registration of regulatory legal acts for No. 11540, published on July 27, 2015 in information system of law of Ad_let):

in Rules of long-term subsidizing of the expenses of carrier connected with implementation of transportations of the passengers according to socially important messages approved by the specified order:

add with Item 1-1 of the following content:

"1-1. The procedure for subsidizing of the expenses of carrier connected with implementation of transportations of the passengers according to socially important messages running is determined by the sites of the railroads of the Republic of Kazakhstan located in the territory of the Russian Federation and the sites of the railroads of the Russian Federation located in the territory of the Republic of Kazakhstan according to rules of subsidizing of expenses of the carriers connected with implementation of rail passenger traffic, approved according to the Protocol on introduction of amendments to the Agreement between the Government of the Republic of Kazakhstan and the Government of the Russian Federation on features of legal regulation of activities of the companies, organizations and organizations of rail transport of October 18, 1996 ratified by the Law of the Republic of Kazakhstan of June 13, 2017.";

"21. The documents confirming rent expenses, acquisition and content of the cars involved in transit passengers according to socially important messages including their planned types of repairs and maintenance is the following:

1) settlement reconciliation statements as of the first day of every month in the accounting period, between the carrier and the organizations performing services in repair (capital repairs, depot repair, capital repairs with prolongation of useful life and capital and recovery repair) and to carrying out maintenance in amounts 1, 2, 3, 4, 5, 6, 7 and 8, and also maintenance of cars;

2) settlement reconciliation statements (as of the first day of every month in the accounting period), between carrier and the organization, the providing service in lease of cars;

3) invoices on rent expenses, content and acquisition of cars, the sheet of charged depreciation and its reference on expenses for the accounting period, invoices and acts of the performed works on expenses on the electric power and diesel fuel;

4) accounts for payment from the organization where cars with the subsequent provision during 7 banking days (after transfer to the account of carrier of the amount of subsidizing) originals of payment orders on payment of acquisition of cars were acquired;

5) notarized copies of credit agreements and the contract on financial leasing for acquisition of cars with appendix of the schedule of the monthly payments and supplementary agreements to them provided in process of their conclusion;

6) other documents confirming the expenses specified in Items 13 and 13-1 of these rules.";

in the Technique of determination of amounts of long-term subsidizing of expenses of the carriers transporting passengers according to socially important messages, approved by the specified order:

add with Item 1-1 of the following content:

"1-1. Determination of amounts of subsidizing of the expenses of carrier connected with implementation of transportations of the passengers according to socially important messages running on the sites of the railroads of the Republic of Kazakhstan located in the territory of the Russian Federation and the sites of the railroads of the Russian Federation located in the territory of the Republic of Kazakhstan is performed according to technique of determination of amounts of subsidizing of expenses of the carriers connected with implementation of rail passenger traffic, approved according to the Protocol on introduction of amendments to the Agreement between the Government of the Republic of Kazakhstan and the Government of the Russian Federation on features of legal regulation of activities of the companies, organizations and organizations of rail transport of October 18, 1996 ratified by the Law of the Republic of Kazakhstan of June 13, 2017.";
