According to Item 3 of article 49 of the Law of the Republic of Kazakhstan "About the security market" (further - the Law on the security market) and subitem 9-3) of article 12 of the Law of the Republic of Kazakhstan "About state regulation, control and supervision of the financial market and the financial organizations" the Board of National Bank of the Republic of Kazakhstan DECIDES:

1. Establish for the organizations performing broker and (or) dealer activities in the security market:

1) following prudential standard rates:

coefficient of sufficiency of equity which value daily makes at least 1;

coefficients of urgent liquidity which values daily make:

K2-1 – at least 1;

K2-2 – is at least 0,9;

K2-3 – is at least 0,8;

K2-4 – is at least 0,5.";

for brokers and (or) dealers for the purpose of receipt of the license for implementation of separate types of the banking activities provided by subitems 1), 2), 3) and 4) of part four of Item 1 of article 63 of the Law on the security market:

the minimum size of the authorized capital – at least 10 000 000 000 (ten billion) tenges;

the minimum size of equity – at least 10 000 000 000 (ten billion) tenges.

2. Approve:

Rules of calculation of values of the prudential standard rates obligatory to observance by the organizations performing broker and (or) dealer activities in the security market according to appendix 1 to this resolution;

Method of calculation of values of the prudential standard rates obligatory to observance by the organizations performing broker and (or) dealer activities in the security market according to appendix 2 to this resolution.

3. Recognize invalid regulatory legal acts of the Republic of Kazakhstan, and also structural elements of some regulatory legal acts of the Republic of Kazakhstan according to the list according to appendix to this resolution.

4. To department of regulation of the non-bank financial organizations (Shaykakova G. Zh.) in the procedure established by the legislation of the Republic of Kazakhstan to provide:

1) together with Legal department (Sarsenov N. V.) state registration of this resolution in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this resolution the direction it the copy in paper and electronic type in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this resolution on Internet resource of National Bank of the Republic of Kazakhstan after its official publication;

4) within ten working days after state registration of this resolution submission to Legal department of data on execution of the actions provided by subitems 2), 3) of this Item and Item 5 of this resolution.

5. To management on consumer protection of financial services and external communications (Terentyev A. L.) provide within ten calendar days after state registration of this resolution the direction it to the copy on official publication in periodic printing editions.

6. To impose control of execution of this resolution on the vice-chairman of National Bank of the Republic of Kazakhstan Kurmanov Zh. B.

7. This resolution becomes effective after ten calendar days after day of its first official publication.

Chapter 1. General provisions

1. These rules of calculation of values of the prudential standard rates obligatory to observance by the organizations performing broker and (or) dealer activities in the security market (further - Rules), are developed according to Item 3 of article 49 of the Law of the Republic of Kazakhstan "About the security market" (further - the Law on the security market), subitem 9-3) of article 12 of the Law of the Republic of Kazakhstan "About state regulation, control and supervision of the financial market and the financial organizations" and establish procedure of payments of values of the prudential standard rates obligatory to observance by the organizations performing broker and (or) dealer activities in the security market (further - the broker and (or) the dealer), including the Voluntary accumulation pension funds, the attraction of voluntary pension contributions combining activities for management of investment portfolio with the right with broker and (or) dealer activities in the security market without the right of account management of clients as the nominee holder (further - DNPF), the managing directors of investment portfolio combining activities for management of investment portfolio without the right of attraction of voluntary pension contributions with broker and (or) dealer activities with the right of account management of clients as the nominee holder (further - the UIP1) managing investment portfolio, combining activities for management of investment portfolio without the right of attraction of voluntary pension contributions with broker and (or) dealer activities without the right of account management of clients (further - UIP2).
