About modification and amendments in some orders of the Minister of Justice of the Republic of Kazakhstan

Bring the following changes and amendments in some orders of the Minister of Justice of the Republic of Kazakhstan:

to state heading of Chapter 1 in the following edition:

"Chapter 1. General provisions";

"1. The state service "Carrying Out Certification on the Occupation Right Notarial Activities" (further – the state service) is rendered based on the standard of the state service "Carrying Out Certification on the Occupation Right Notarial Activities" approved by the order of the Minister of Justice of the Republic of Kazakhstan of April 24, 2015 No. 232 (it is registered in the Register of state registration of regulatory legal acts for No. 11095) (further - the Standard), territorial authorities of justice (further – the service provider).

Reception of applications and issue of results of rendering the state service is performed through the web portal of "the electronic government" www.egov.kz (further - the portal).

Result of rendering the state service: the decision on passing of certification by persons applying for the occupation right notarial activities for form according to appendix 1 to the Standard or the decision on not passing of certification by persons applying for the occupation right notarial activities for form according to appendix 2 to the Standard or motivated refusal in the admission to certification for the bases specified in Item 10 of the Standard.

The result of rendering the state service is drawn up electronically, certified by the digital signature (further – the EDS) the authorized person of the service provider and goes to "personal account" of uslugopoluchatel in electronic form no later than the next working day after carrying out certification.";

"Chapter 2. The description of operations procedure of structural divisions (workers) of the service provider in the course of rendering the state service";

5. Contents of each procedure (action), being part of process of rendering the state service, duration of its accomplishment:

1) registration of a statement - within 1 (one) working day from the date of receipt of documents;

2) the direction of the statement the head of the service provider to the head of department of right explanatory work and rendering legal services (further - the head of department) - within 1 (one) working day from the date of receipt of documents;

3) the direction of the statement the head of department for consideration to the specialist of department of right explanatory work and rendering legal services (further - the specialist of department) - within 1 (one) working day from the date of receipt of documents;

4) specialist of department:

within 1 (one) working day checks completeness of the submitted documents, in case of factual determination of incompleteness of the submitted documents within the specified terms prepares written motivated refusal in further review of the statement;

5) the head of the service provider within 4 (four) hours signs motivated refusal in further review of the statement;

7) the head of the service provider within 4 (four) hours signs the notification about carrying out certification on the occupation right notarial activities;

8) the employee of office of the service provider in day of signing of the notification sends him to uslugopoluchatel;

9) carrying out certification on the occupation right notarial activities;

10) registration of result of rendering the state service – within 1 (one) working day after carrying out certification.";

"Chapter 3. The description of order of interaction of structural divisions (workers) of the service provider in the course of rendering the state service";

"7. The description of the sequence of procedures (actions) between structural divisions (workers) of the service provider and duration of its accomplishment:

1) the employee of office of the service provider within 1 (one) working day from the date of receipt of documents carries out registration of the received documents, and submits the head of the service provider;

2) the head of the service provider within 1 (one) working day from the date of receipt of documents, directs the application of uslugopoluchatel to the head of department;

3) the head of department within 1 (one) working day from the date of receipt of documents, directs the application of uslugopoluchatel to the specialist of department;
