About introduction of amendments to article 7 of the Law of Ukraine "About rehabilitation of persons with disability in Ukraine" concerning establishment of group of disability

The Verkhovna Rada of Ukraine decides:

I. Bring in article 7 of the Law of Ukraine "About rehabilitation of persons with disability in Ukraine" (Sheets of the Verkhovna Rada of Ukraine, 2006, No. 2-3, of Art. 36; 2012, No. 31, Art. 381; 2014, No. 36, Art. 1184; 2018, Art. No. 6-7, 43) following changes:

the fifth parts nine to add the paragraph with the offer of the following content: "If person who addresses for disability establishment cannot arrive to survey (re-examination) to the commission for health reasons according to the conclusion of the medical and advisory commission, inspection (re-examination) is performed in the place of its accommodation (house), including at the place of residence in stationary organizations for citizens of advanced age and persons with disability, organizations of social protection for homeless persons and the centers of social adaptation of persons or in healthcare institutions in which such person is on treatment";

the thirteenth to state part in the following edition:

"To persons who handle for establishment of the disability caused by availability of anatomic defects, other irreversible violations of functions of bodies and systems of organism, including irreversible loss (amputation) of the upper and/or lower extremities (their parts) and also to persons disability at which the term of re-examination comes after achievement of retirement age, the stipulated in Clause 26 Laws of Ukraine "About obligatory national pension insurance" the corresponding group of disability is established without specifying of term of re-examination (is termless). To persons who owing to wound, contusions, mutilations or diseases got with direct participation in anti-terrorist operation, ensuring its carrying out, being directly in areas of anti-terrorist operation during its carrying out, during direct participation in implementation of actions for ensuring national security and defense, repulse and control of the armed aggression of the Russian Federation in the Donetsk and Luhansk regions, ensuring their implementation, being directly in areas and during implementation of the specified actions, sustained damage which led to irreversible loss (including amputations) the upper and / or lower extremities (their parts), irreversible loss of other body or complete permanent loss of its functions by body that resulted in disability, the group of disability is established without specifying of term of re-examination one step above the criteria of establishment of group of disability determined by the legislation (is termless), but it is not higher than I group. Re-examination for the purpose of increase in group of disability to such persons is performed based on the application in person of person with disability or his legal representative in case of approach of changes in the state of health and operability of person with disability or by a court decision".

II. Final provisions

1. This Law becomes effective from the date of, its publication following behind day.

2. To the Cabinet of Ministers of Ukraine in a month from the date of entry into force of this Law:

bring the regulatory legal acts into accord with this Law;

provide review and reduction by the ministries and other central executive bodies of their regulatory legal acts in compliance with this Law.
