About modification and amendments in some orders of the Ministry of the industry and new technologies of the Republic of Kazakhstan and the Ministry for Investments and Development of the Republic of Kazakhstan concerning rendering the state services

According to Item 2 of article 50 of the Law of the Republic of Kazakhstan of April 6, 2016 "About legal acts" I ORDER:

1. Approve the enclosed list of some orders of the Ministry of the industry and new technologies of the Republic of Kazakhstan and the Ministry for Investments and Development of the Republic of Kazakhstan concerning rendering the state services to which changes and additions are made.

2. To provide to department of documentation and control of the Ministry for Investments and Development of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy on paper and electronically in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) within ten calendar days after state registration of this order the direction it the copy on official publication in periodic printing editions;

4) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan;

5) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of actions, according to subitems 1), 2), 3) and 4) this Item.

3. To impose control of execution of this order on the responsible secretary of the Ministry for Investments and Development of the Republic of Kazakhstan.

4. This order becomes effective after twenty one calendar days after day of its first official publication.

In the order of the acting minister on investments and development of the Republic of Kazakhstan of January 23, 2015 No. 45 "About approval of qualification requirements for implementation of activities in the field of the industry and the list of the documents confirming compliance to them" (registered in the Register of state registration of regulatory legal acts for No. 10427, published on March 27, 2015 in information system of law of Ad_let):

3. In the order of the acting minister on investments and development of the Republic of Kazakhstan of January 23, 2015 No. 51 "About approval of Rules of state registration of the vessel, including small size vessel, and the rights to it" (registered in the Register of state registration of regulatory legal acts for No. 10400, published on March 17, 2015 in information system of law of Ad_let):

in Rules of state registration of the vessel, including small size vessel, and the rights to it approved by the specified order:

add with Item 10-1 of the following content:

"10-1. State registration of courts behind physical persons is performed in place of registration of physical person.

State registration of courts for legal entities is performed in the location of the legal entity, or its branch or representation.";

state Item 14 in the following edition:

"14. The term of consideration of the submitted application constitutes 7 (seven) working days from the moment of its receipt following the results of which permission to provision of the temporary right of swimming under National flag of the Republic of Kazakhstan or written motivated refusal is issued.

The authorized body refuses issue of the temporary right of swimming under National flag of the Republic of Kazakhstan, on the following bases:

1) establishment of unauthenticity of the documents submitted by the shipowner, and (or) these (data) containing in them;

2) discrepancy of the shipowner and (or) the provided materials, objects, supplied and the information necessary for issue of permission to provision of the temporary right of swimming under National flag of the Republic of Kazakhstan, to the requirements established by these rules;

3) concerning the shipowner there is judgment which took legal effect based on which the shipowner is deprived of the special right connected with receipt of permission to provision of the temporary right of swimming under National flag of the Republic of Kazakhstan.";

"19. The term of state registration of the vessel and the rights to it constitutes 7 (seven) working days from the date of filing of application. The term of issue of the duplicate of the Ship certificate constitutes 2 (two) working days from the date of filing of application.

20. The territorial subdivision refuses state registration of the vessel and the rights to it, and also issue of the duplicate of the Ship certificate, on the following bases:

1) establishment of unauthenticity of the documents submitted by the shipowner, and (or) these (data) containing in them;

2) discrepancy of the shipowner and (or) the provided materials, objects, supplied and the information necessary for issue of the certificate, to requirements, the established these rules;

3) concerning the shipowner there is judgment which took legal effect based on which the shipowner is deprived of the special right connected with receipt of the certificate.";

21, 22 and 23 to exclude Items;

state Item 26 in the following edition:

"26. The state re-registration of courts with issue of the new Ship certificate is performed 7 (seven) working days from the date of filing of application in time.

The territorial subdivision refuses the state re-registration of courts on the following bases:

1) establishment of unauthenticity of the documents submitted by the shipowner, and (or) these (data) containing in them;

2) discrepancy of the shipowner and (or) the provided materials, objects, supplied and the information necessary for issue of the certificate, to the requirements established by these rules;

3) concerning the shipowner there is judgment which took legal effect based on which the shipowner is deprived of the special right connected with receipt of the certificate.";

state Item 31 in the following edition:

"31. State registration of mortgage of the vessel makes sure issue of the Certificate on state registration of mortgage of the vessel, in form according to appendix 5 to these rules.

The term of issue of the Certificate on state registration of mortgage of the vessel constitutes 7 (seven) working days from the moment of filing of application.

The territorial subdivision refuses state registration of mortgage of the vessel, on the following bases:

1) establishment of unauthenticity of the documents submitted by the shipowner, and (or) these (data) containing in them;

2) discrepancy of the shipowner and (or) the provided materials, objects, supplied and the information necessary for issue of the certificate, to the requirements established by these rules;

3) concerning the shipowner there is judgment which took legal effect based on which the shipowner is deprived of the special right connected with receipt of the certificate.";

to state part one of Item 35 in the following edition:

"35. The additional leaf to the Certificate on state registration of mortgage of the vessel is issued by territorial subdivision based on the statement (any form) of the pledger. The term of issue of additional leaf to the Certificate on state registration of mortgage of the vessel constitutes 7 (seven) working days from the date of filing of application.";

to state part one of Item 36 in the following edition:

"36. In case of loss by the pledger of the vessel of the certificate on state registration of mortgage of the vessel the territorial subdivision according to the statement of the pledger according to appendix 4 to these rules issues the duplicate of the certificate. The term of issue of the duplicate of the certificate constitutes 2 (two) working days.";

"43. Date of suspension of the right of swimming under National flag of the Republic of Kazakhstan date of entering of the corresponding mark into the State ship register of the Republic of Kazakhstan is considered. The term of entering of mark into the ship certificate constitutes 7 (seven) working days from the date of filing of application.";

3) concerning the shipowner there is judgment which took legal effect based on which the shipowner is deprived of the special right connected with receipt of the certificate.";

Issue of the duplicate of the ship ticket is made on provision of the statement in form, according to appendix of 15 these rules. The term of issue of the duplicate of the ship ticket constitutes 2 (two) working days.";

"76. The territorial subdivision refuses state registration of the small size vessel and the rights to it on the following bases:

1) establishment of unauthenticity of the documents submitted by the shipowner, and (or) these (data) containing in them;
