About introduction of amendments to the order of the Minister of Energy of the Republic of Kazakhstan of April 22, 2015 No. 299 "About approval of standards of the state services in the field of use of atomic energy"

I ORDER:

1. Bring in the order of the Minister of Energy of the Republic of Kazakhstan of April 22, 2015 No. 299 "About approval of standards of the state services in the field of use of atomic energy" (No. registered in the Register of state registration of regulatory legal acts 11222, published on July 14, 2015 in information system of law of Ad_let) the following changes:

1, of 2, of 3, of 4, of 5, of 6, of 7, of 8, 9 and 10 to the specified order to be reworded as follows appendices according to appendices 1, of 2, of 3, of 4, of 5, of 6, of 7, of 8, 9 and 10 to this order;

in the standard of the state service "Certification of the Personnel Occupied on Subjects to Use of Atomic Energy" approved by the specified order:

state Items 16 and 17 in the following edition:

in the standard of the state service "Accreditation of the Organizations on the Right of Conducting Examination of Nuclear, Radiation, Nuclear Physical Safety" approved by the specified order:

in the standard of the state service "Approval of Designs of Transport Packaging Sets, and also Distribution of Action of Certificates Permissions on Them Approved by Authorized Bodies of Other Countries in the territory of the Republic of Kazakhstan" approved by the specified order:

"16. Uslugopoluchatel has possibility of receipt of information on procedure and the status of rendering the state service in the mode of remote access by means of "personal account" through the portal, and also Single contact center.

2. To provide to committee of atomic and energy supervision and control of the Department of Energy of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy in paper and electronic type in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information of the Ministry of Justice of the Republic of Kazakhstan" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) within ten calendar days after state registration of this order the direction it the copy on official publication in periodic printing editions;

4) placement of this order on official Internet resource of the Department of Energy of the Republic of Kazakhstan;

5) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Department of Energy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 2), 3) and 4) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Energy of the Republic of Kazakhstan.

4. This order becomes effective after twenty one calendar days after day of its first official publication.

Standard of the state service "Licensing for Performance of Works, the Subjects to Use of Atomic Energy Connected with Stages of Lifecycle"

Chapter 1. General provisions

1. The state service "Licensing for Performance of Works, the Subjects to Use of Atomic Energy Connected with Stages of Lifecycle" (further – the state service).

2. The standard of the state service is developed by the Department of Energy of the Republic of Kazakhstan (further – the Ministry).

3. The state service appears Committee of atomic and energy supervision and control of the Ministry (further – the service provider).

Reception of an application and issue of result of rendering the state service is performed through the web portal of "the electronic government" www.egov.kz, www.elicense.kz (further – the portal).

Chapter 2. Procedure for rendering the state service

4. The term of rendering the state service from the moment of the address on the portal:

when licensing and (or) appendices to the license – 30 (thirty) working days;

in case of renewal of the license and (or) appendix to the license – 3 (three) working days, in cases:

changes of the name and (or) location of legal person licensee;

address modifications of the location of object without its physical movement for the license granted on class "the permissions issued on objects" or for appendices to the license with indication of objects;

availability of the requirement about renewal in the laws of the Republic of Kazakhstan;

by reorganization of legal person licensee in forms of merge, transformation, in the form of joining of legal person licensee to other legal entity;

in case of renewal of the license and (or) appendix to the license in cases of reorganization of legal person licensee in forms of allocation and separation – 30 (thirty) working days.

The service provider from the moment of receipt of documents of the legal entity (further – uslugopoluchatel) checks completeness and effective period of the submitted documents. In case of factual determination of incompleteness and expiration of the submitted documents the service provider within two working days gives motivated refusal in further review of the statement.

5. Form of rendering the state service: electronic (partially automated).

6. Result of rendering the state service – the license and (or) appendix to the license, renewal of the license and (or) the appendix to the license for performance of works connected with stages of lifecycle of subjects to use of atomic energy the granted application on withdrawal of uslugopoluchatel or the motivated answer for refusal in rendering the state service, in cases and on the bases, stipulated in Item 10 these standards of the state service.

Form of provision of result of rendering the state service: electronic.

7. The state service is rendered on paid basis. When rendering the state service in the budget for the location of uslugopoluchatel according to article 471 of the Code of the Republic of Kazakhstan of December 10, 2008 "About taxes and other obligatory payments in the budget (Tax code)" the license fee is paid for the right by occupation separate types of activity:

1) the license fee when licensing for the occupation right this type of activity constitutes 100 monthly settlement indicators (further – MRP);

2) the license fee for renewal of the license constitutes 10% of rate when licensing, but no more than 4 MRP.

Payment of the license fee is performed in cash and non-cash forms through the banks of the second level and the organization performing separate types of banking activities and also through payment gateway of "the electronic government" (further – PShEP).

8. Working schedule:

1) the service provider – Monday through Friday, from 9-00 till 18-30 o'clock, with lunch break from 13-00 till 14-30 o'clock, except days off and holidays according to the labor law.

The state service is rendered in turn, without making an appointment and the accelerated servicing.

2) the portal – round the clock, except for technical breaks in connection with carrying out repair work (in case of the address of uslugopoluchatel after the termination of working hours, in days off and holidays according to the labor law of the Republic of Kazakhstan, reception of an application and issue of result of rendering the state service is performed the next working afternoon).

9. List of the documents necessary for rendering the state service in case of the address of uslugopoluchatel:

1) for receipt of the license and (or) appendix to the license:

the statement of the legal entity according to appendix 1 to this standard of the state service in electronic form certified by the EDS of uslugopoluchatel;

the electronic copy of the document confirming payment in the budget of the license fee for the right with occupation separate types of activity, except as specified payments through PShEP. In case of issue of appendices to the license the license fee is not levied;

electronic copies of the documents to activities for performance of works connected with stages of lifecycle of subjects to use of atomic energy (further – electronic copies of documents) according to appendix 2 to this standard of the state service;

form of the data to activities for performance of works connected with stages of lifecycle of subjects to use of atomic energy (further – form of data) according to appendix 3 to this standard of the state service;

2) for renewal of the license and (or) appendix to the license:

the statement of the legal entity for the renewal of the license and (or) appendix to the license according to appendix 4 to this standard of the state service in electronic form certified by the EDS of uslugopoluchatel;

the electronic copy of the document confirming payment in the budget of the license fee for renewal of the license and (or) appendix to the license, except as specified payments through PShEP;

electronic copies of the documents containing information on changes, which formed the basis for renewal of the license and (or) appendix to the license, except for documents from which information contains in the state information systems;

electronic copies of documents according to appendix 2 to this standard of the state service in cases of reorganization of legal person licensee in forms of allocation and separation;

form of data according to appendix 3 to this standard of the state service in cases of reorganization of legal person licensee in forms of allocation and separation.

About the sanitary and epidemiologic conclusion issued by department and its territorial subdivisions of state body in the field of sanitary and epidemiologic wellbeing of the population, the service provider receives data of documents on state registration (re-registration) of the legal entity, on the license, on payment through PShEP from the corresponding state information systems through lock of "the electronic government".

In the absence of data in the state information systems the uslugopoluchatel provides the electronic copy of the sanitary and epidemiologic conclusion issued by department and its territorial subdivisions of state body in the field of sanitary and epidemiologic wellbeing of the population.

When giving the uslugopoluchatel of all necessary documents through the portal – in "personal account" of uslugopoluchatel displays the status about acceptance of request for rendering the state service.

If the license and (or) appendix to the license were issued in paper form, the uslugopoluchatel according to the statement transfers them to electronic format and receives electronic form of the license.

10. The bases for refusal in rendering the state service are:

occupation type of activity is forbidden by the laws of the Republic of Kazakhstan for this category of legal entities;

the license fee is not brought;

the uslugopoluchatel does not conform to qualification requirements;

concerning uslugopoluchatel there is decision (sentence) of court on suspension or prohibition of activities or the separate types of activity which are subject to licensing took legal effect;

court based on representation of the legal executive the uslugopoluchatelyu-debtor is temporarily forbidden to grant licenses.

Chapter 3. Procedure for appeal of decisions, actions (bezdeystviye) of the central state body, and also the service provider and (or) his officials concerning rendering the state services

11. In case of appeal of decisions, actions (bezdeystviye) of the service provider and (or) his officials the claim addressed to the head of the service provider or addressed to the head of the Ministry of the address specified in Item 13 of this standard of the state service is submitted.

Claims are accepted in writing by mail or purposely through office of the service provider or the Ministry in the working days, or by means of the portal.

The claim is signed by uslugopoluchatel in which its surname, name, middle name (is entered in case of its availability), reference number and date, the postal address, contact telephone number.

Confirmation of adoption of the claim is its registration (stamp, the entering number and date) in office of the service provider, or the Ministry with indication of surname and initials of person which accepted the claim.

The claim of uslugopoluchatel which arrived to the service provider or the Ministry is subject to consideration within five working days from the date of its registration. The motivated answer about results of consideration of the claim goes to uslogopoluchatel by means of mail service or the portal, or is issued purposely in office of the service provider or the Ministry.

In case of disagreement with results of the rendered state service the uslugopoluchatel can address with the claim to authorized body by assessment and control of quality of rendering the state service.

The claim of uslugopoluchatel which arrived to authorized body by assessment and control of quality of rendering the state service is subject to consideration within fifteen working days from the date of its registration.

12. In disagreement cases with results of the rendered state service the uslugopoluchatel takes a legal action in the procedure established by the legislation of the Republic of Kazakhstan.

Chapter 4. Other requirements taking into account features of rendering the state service including rendered electronically

13. The address of the place of rendering the state service is placed:

1) on Internet resource of the Ministry – www.energo.gov.kz, the Section "State Services";

2) on Internet resource of the service provider – www.kaenk.energo.gov.kz, the Section "State Services".

14. Uslugopoluchatel has possibility of receipt of the state service electronically through the portal on condition of EDS availability.

15. Uslugopoluchatel has possibility of receipt of information on procedure and the status of rendering the state service in the mode of remote access by means of "personal account" through the portal, and also Single contact center.

16. Single contact center: 1414, 8 800 080 7777.
