About entering of amendment into the Law on investments into business activity No. 81/2004
The Parliament adopts this organic law.
Art. I. – The law on investments into business activity No. 81/2004 (2004, Art. No. 64-66, 344), with subsequent changes and amendments, to add the official monitor of the Republic of Moldova with Article 12-1 of the following content:
"Article 12-1. Conclusion of investment agreements
(1) For the purpose of decrease in investment risks and establishment of support of strategic investment projects from the state the Government within the competence can sign investment agreements on implementation of such projects.
(2) strategic investment projects are understood as the investment projects directed to implementation of state programs and strategy and promoting growth of national economy or making positive impact on sustainable social and economic development of the country.
(3) Criteria of determination and selection of strategic investment projects, procedure for development (including structural elements), the conclusion and monitoring of implementation of investment agreements, and also the rights and obligations concerning investments are established by the Government.
(4) the investment agreements Signed by the Government cannot provide to the investor tax and customs privileges, as well as contain the provisions sent to damage to other business entity performing activities in the territory of the Republic of Moldova.
(5) If the investment agreement should give the status of the international treaty, it shall consist with observance of provisions of the Law on international treaties of the Republic of Moldova No. 595/1999.".
Art. II. – To the government in four-months time from the date of publication of this law to bring the regulations into accord with it.
