About modification and amendments in some legal acts

The Parliament adopts this organic law.

Art. I. – In the Family code No. 1316/2000 (Official monitor of the Republic of Moldova, 2001, Art. No. 47-48, 210), with subsequent changes and amendments, to make the following changes and additions:

1. In part (Article 14 of the word "body of local public authority" shall be replaced with words 2) "local body of guardianship".

2. Part (Article 47 to add 2) with the offer: "Having obtained information on case of the birth of the child or on the address of mother after the delivery, the local medical and sanitary organization / the family doctor shall take necessary measures for factual determination of the birth of the child within three working days, and in case of its establishment – to issue the medical certificate stating the child's birth even if mother does not live in this area.".

3. Part (Article 51 to state 4) in the following edition:

"(4) in case of the children separated from parents, the child's rights to care of it and his education are provided with his legal representative.".

4. In Article 53:

part (to add 2) with the offer: "Parents bear stipulated by the legislation responsibility for failure to carry out or inadequate accomplishment of the obligations on child care and its education.";

add Article with part (5-1) following contents:

"5-1) If accommodation of the child in social service of placement is caused by violence, neglect, operation, refusal or other actions posing threat for life and health of the child, the degree of jurisdiction upon the demand of territorial authority of guardianship considers the possibility of collection from the guilty parent / parents in the procedure for costs for child care and its education established by the Government in social service / services from the moment of its placement to reintegration into family.";
