About modification and amendments in article 31 of the Law on mortgage No. 142/2008

In article 31 of the Law on mortgage No. 142/2008 (Official monitor of the Republic of Moldova, 2008, Art. No. 165-166, 603), with subsequent changes and amendments, to make the following changes and addition:

"(2) the Notification shall be sent at the place of residence or the location of the mortgage debtor and, in case of need, the debtor or to other address specified for this purpose in the agreement of mortgage by means of the registered mail with confirmation on obtaining. The notification can be sent also by means of other means of communication provided by the agreement of mortgage allowing to confirm departure and receipt of the notification.";

add Article with parts (2-1)–(2-6) of the following content:

"(2-1) Notification are considered received on the date of delivery of the registered mail with confirmation on obtaining. Date of delivery of the registered mail with confirmation on obtaining and the signature of the mortgage debtor / debtor are put down on the form of confirmation about obtaining.

(2-2) If the mortgage debtor / debtor refuses receipt of the registered mailing which arrived on his name, the post worker asks it to put down the mark "I Refuse to Receive", having assured the signature on the form of confirmation about obtaining. If the mortgage debtor / debtor refuses to put down such mark, the post worker makes entry "Refused. The receiver refuses to make mark.", then undersigns and dates.

(2-3) Mortgage debtor/debtor, which according to part (2-2) refuses to receive the registered mail with confirmation on obtaining containing the notification of the mortgage provider it is considered notified from the date of refusal if on the letter and the form of confirmation on obtaining by the mortgage provider (sender) the mark "Notification of the Mortgage Debtor / Debtor" is made.
