About modification and amendments in some resolutions of Council of Ministers of the Republic of Belarus

According to Item 2 of the Presidential decree of the Republic of Belarus of September 1, 2016 "About entering of amendments and changes into the Presidential decree of the Republic of Belarus" and for the purpose of enhancement of regulation of single questions in the field of estimative activities in the Republic of Belarus the Council of Ministers of the Republic of Belarus DECIDES: No. 326

1. Make changes and additions to the following resolutions of Council of Ministers of the Republic of Belarus:

1.1. in the resolution of Council of Ministers of the Republic of Belarus of February 5, 2007 No. 148 "About approval of the Regulations on procedure for carrying out certification of appraisers and Regulations on procedure for maintaining the state register of appraisers" (The national register of legal acts of the Republic of Belarus, 2007, No. 40, 5/24666; 2009, No. 14, 5/29066; 2011, No. 22, 5/33322; 2012, No. 47, 5/35576):

1.1.1. to state the name of the resolution in the following edition:

"About measures for implementation of the Presidential decree of the Republic of Belarus of October 13, 2006 No. 615";

1.1.2. state paragraph two in the following edition:

"Regulations on procedure for carrying out certification of applicants for receipt of the certificate on certification of the appraiser, issue of the certificate on certification of the appraiser, introduction in it of changes and (or) amendments, prolongation of effective period, cancellation and the termination of its action, issue of its duplicate, accounting of the granted certificates;";

1.1.3. in Regulations on the procedure for carrying out certification of appraisers approved by this resolution:

1.1.3.1. to state the name of the Provision in the following edition:

"Regulations on procedure for carrying out certification of applicants for receipt of the certificate on certification of the appraiser, issue of the certificate on certification of the appraiser, introduction in it of changes and (or) amendments, prolongation of effective period, cancellation and the termination of its action, issue of its duplicate, accounting of the granted certificates";

1.1.3.2. in Item 1 of the word of "physical persons on the right of carrying out independent value assessment of objects of assessment" and "prolongation, the terminations of effective period of the certificate" to replace respectively with words "applicants for receipt of the certificate on certification of the appraiser (further - the applicant)" and "prolongation of effective period, cancellation and cancellation of the certificate, accounting of the granted certificates";

1.1.3.3. add the Provision with Item 1-1 of the following content:

"1-1. For the purposes of this provision the following terms and their determinations are used:

certification of the applicant for receipt of the certificate on certification of the appraiser (further - certification) - assessment procedure of professional competence of the applicant in the form of testing certification by results of which the decision on issue (refusal in issue) certificates is made;

leaf of input data - the sheet of paper of format A 4, which contains the personal data of the applicant necessary for authorization of the computer test, and information on procedure for passing of this test.";

1.1.3.4. in Item 2 of the word of "the cost of objects of assessment" shall be replaced with words "objects of the civil laws";

1.1.3.5." (further - the applicant)" to exclude from Item 3 of the word;

1.1.3.6. in item 4:

in part one:

to exclude the word of "appraisers";

shall be replaced with words the word "assessment" "civil laws";

the second to state part in the following edition:

"For the organization and carrying out certification, consideration of the documents connected with prolongation of effective period of the certificate, the certifying body creates the commission on certification (further - certifying commission).";

1.1.3.7. state Item 5 in the following edition:

"5. Certifying commission:

holds testing certification;

considers results of testing certification at the meetings;

considers appeals of applicants;

considers the copies of the conclusion and the valuation report represented by appraisers for prolongation of effective period of certificates;

performs other functions.";

1.1.3.8. in Item 7:

third to state the paragraph in the following edition:

"posts on the official site of the State committee on property or on the website of public institution "National center of intellectual property" on the global computer Internet information on date, time and the venue of certification, and also informs on date, time and the venue of certification of each applicant according to the procedure and the terms established by this Provision;";

add Item with paragraphs the fifth and sixth the following content:

"prepares the draft decision of the certifying body about issue (about refusal in issue) certificates, prolongation (refusal in prolongation) the term of its action according to the minutes of certifying commission;

carries out at the request of the chairman of certifying commission (in its absence - the vice-chairman of certifying commission) other functions connected with certification and prolongation of effective periods of certificates.";

1.1.3.9. state Item 8 in the following edition:

"8. Before certification the applicant has the right to have training within development of contents of the educational program of advanced training of leading employees and specialists, and also within development of contents of the educational program of the training rates realized by public institution "National center of intellectual property".";

1.1.3.10. in Item 9 part one:

to exclude from paragraph one of the word "on receipt of the certificate";

after the paragraph of third to add part with the paragraph of the following content:

"the certificate on recognition of the education document issued in foreign state, and establishment of its equivalence (compliance) to the education document of the Republic of Belarus - for the applicants who got the corresponding education abroad;";

to consider paragraphs of the fourth or seventh respectively paragraphs the fifth or eighth;

1.1.3.11. state Items 10 and 11 in the following edition:

"10. In the statement for certification and issue of the certificate on certification of the appraiser by applicants the type of object of the civil laws for which it applies to receive the certificate is specified.
