Article 1. To state article 158 of the Criminal code of the Republic of Armenia of April 18, 2003 (further – the Code) in the following edition:
"Article 158. Violation of copyright and related rights
1. Illegal use of object of copyright and related rights or assignment of authorship, and also record, distribution and (or) sale of the work on magnetic audio-video the carrier for the purpose of profit earning without the consent of the copyright owner or the related rights if this act the act was made in large sizes:
attracts infliction of penalty, from five hundred to the thousandfold size of minimum wage, or arrest – for a period of one up to two months, or imprisonment, for the maximum term one year.
2. Same act, committed:
1) bypassing technical measures of protection;
2) group of persons in prior consent;
3) more than once;
4) with gluing of the received brands on carriers of the works which are not provided for their use;
5) in large sizes:
attracts infliction of penalty, from the thousandfold size of minimum wage, thousandfold to two, or imprisonment, for the maximum term two years.
3. The act provided by this Article is considered committed in considerable sizes if the total cost (price) of the right (license) for permission of use of object of copyright or the related rights on copies of magnetic audio-videos of carriers, regardless of owners of the rights, at the prices specified at the author or other owner of the rights (and if it is not specified, at retail market prices) constitutes from fifty multiple up to two hundred multiple sizes of the minimum wage operating at the time of crime.
