About modification and amendments in the Law on social benefit No. 133-XVI of June 13, 2008

The Parliament adopts this organic law.

Art. I. – In the Law on social benefit No. 133-XVI of June 13, 2008 (Official monitor of the Republic of Moldova, 2008, No. 179, of the Art. 625), with subsequent changes and amendments, to make the following changes and additions:

1. In article 3 to state the concept "needy family" of the following edition:

"needy family – family which has comprehensive average monthly income less than the minimum guaranteed monthly income and which has score on welfare measures less, than the threshold established for family welfare assessment.".

2. Item c) parts (Article 5 to state 1) in the following edition:

"c) are the unemployed registered in territorial agency of employment of the population;".

3. In Article 6:

"(2) If the calculated monthly size of social benefit for one family is less than 25 lei, the social benefit is established in the amount of 25 lei a month.".

5. State Article 9 in the following edition:

"Article 9. Purpose of social benefit and/or benefit for the cold period of year

(1) the Social benefit and/or benefit for the cold period of year are appointed by management/department of social security and protection of family.

(2) the Social benefit and/or benefit for the cold period of year are appointed based on the registered application for provision of the social benefit submitted by one of family members having full legal capacity, appointed by family or in the cases provided by the law her legal representative.
