About modification and amendments in the Law of the Republic of Armenia "About the body regulating public services"

Article 1. In article 7 of the Law of the Republic of Armenia "About the body regulating public services" (ZR-18-N of December 25, 2003):
a) state Item 3 in the following edition:
"3. Citizens of the Republic of Armenia who are able to provide with the professional opportunities fulfillment of duties, established by the laws and other legal acts can be appointed members of the commission the having higher education, labor experience in the field of management.
The maximum age for holding the post of the member of the commission of 65 years.";
b) to add the first paragraph of Item 5 with the subitem "g" of the following content:
"d) in case of achievement of the maximum age for holding the post".
Article 2. To state article 12 of the Law in the following edition:
"Article 12. Appeal of legal acts of the Commission
1. Legal acts of the Commission can be appealed judicially.
2. The size of the rate established by the Commission can be appealed judicially in 7-day time from coming into force of the legal act of the Commission establishing rate size.
Appeal judicially does not suspend the legal act of the Commission establishing rate size.
3. In case of appeal judicially of rate size, the court checks its compliance to the laws.
In case of availability of violation of the law, the court accepts the resolution on the offer of adoption by the Commission of the new decision on settlement of a tariff, having indicated the need reductions in compliance of the legal act of the Commission to requirements of the laws, with simultaneous application of such means of legal regulation which will give the chance of the Commission in reasonable time to make the new decision on settlement of a tariff.
The commission considers the court order and makes the relevant decision.
