About entering of amendments into the Code of penal procedure of the Republic of Armenia

Article 1. Article 118 of the Code of penal procedure of the Republic of Armenia of July 1, 1998 (further – the Code):

To add 1) with parts 1.1 and 1.2 of the following content:

"1.1. The physical evidences which are subject of pledge and other withdrawn objects which are pledge subject of the decision of the body performing production return to their legal owner after implementation of all investigative actions if it does not do harm to the competent evidence.

1.2. The legal relationship connected with removal from arrest of the physical evidences which are under arrest are regulated by part 1.1 of Article 238.".

Article 2. To add article 238 of the Code with part 1.1 following of content:

"1.1. If the subject of pledge is under arrest, the body performing criminal proceedings for the petition of the pawnbroker, makes the decision on removal from arrest of this property if the subject of pledge is not:

a) the property acquired in the criminal way

b) the property directed to terrorism financing

c) the property necessary for compensation of damage caused to the civil claimant by crime, the rights to pledge or property of which are disputed judicially by the third parties.

The means which remained after satisfaction of requirements of the pawnbroker and reduction of expenses on realization of property, the pawnbroker transfers to the deposit of the body performing criminal proceedings.".

Article 3. This Law becomes effective for the tenth day after official publication.
