About modification and amendments in the Instruction on enforcement proceeding
Based on paragraph two of subitem 6.35 of Item 6 and Item 11 of the Regulations on the Ministry of Justice of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of October 31, 2001 No. 1605, the Ministry of Justice of the Republic of Belarus DECIDES:
1. Bring in the Instruction on enforcement proceeding approved by the resolution of the Ministry of Justice of the Republic of Belarus of December 20, 2004 No. 40 (The national register of legal acts of the Republic of Belarus, 2005, No. 2, 8/11871; 2011, No. 119, 8/24236; 2012, No. 26; 8/24948; No. 66, 8/25934; National legal Internet portal of the Republic of Belarus, 16.01. 2013, 8/26753; 11:06. 2013, 8/27594; 30.10. 2013, 8/28019; 26.04. 2014, 8/28613; 23:01. 2015, 8/29442; 12:12. 2015, 8/30418), following changes and amendments:
1.1. in part eight of Item 37 and the paragraph third "other penalties made in the income of the state" shall be replaced with words parts one of Item 49 of the word "recovery of penalty on criminal case";
1.2. in part three of Item 52 of figure "171" to replace with figures "72";
1.3. in Item 78:
third to state part in the following edition:
"The act of the inventory and seizure of property is handed personally to the parties of enforcement proceeding, to the keeper of property, and also other participants of enforcement proceeding in the cases provided by the Code of civil procedure of the Republic of Belarus or goes it post correspondence or with use of information technologies.";
