About modification and amendments in some legal acts
The Parliament adopts this organic law.
Art. I. – In the Law on financial institutions No. 550-XIII of July 21, 1995 (repeated publication: The official monitor of the Republic of Moldova, 2011, Art. No. 78-81, 199), with subsequent changes to make the following changes and additions:
1. In Item c) parts (3) Article 7 of the word of "the contract with auditing organization" shall be replaced with words "contracts with auditor society".
2. In part (Article 9 of the word "in Article 17." shall be replaced with words 1) "in part (3) Article 17.".
3. Part (Article 10 to add 1) with Item m) the following content:
"m) violations of requirements of the legislation for the prevention and anti-money laundering and terrorism financing.".
4. In Article 15:
in part (1):
Item c) to state in the following edition:
"c) any person cannot accept bank shares as contribution to the authorized capital;";
add part with Item d) the following content:
"d) any person individually or as a part of group of cooperative persons cannot acquire the share or be signed on the bank shares issued according to part provisions (3) Article 15-6.";
part (to add 2) after the words "from the date of the acquisition performed with violation of provisions of part (1)." with the offer: "Shares according to which implementation of voting power is suspended are not considered in case of decision making on the questions included in the agenda of general shareholder meeting not taken into consideration in case of determination of results of vote and respectively do not join in the voices provided at meeting.".
5. Part (Article 15-1 after words of "audit committee" to add 1) with words ", the rights to dividends".
6. In Article 15-2:
in part (1-1) words "in Items b) and c) parts (Articles 15," shall be replaced with words 1) "in Items b), c) and d) parts (1) Articles 15,";
