About modification and amendments in the resolution of the Ministry of Justice of the Republic of Belarus of February 19, 2002 No. 3
Based on Item 2 of article 57 of the Law of the Republic of Belarus of July 18, 2004 "About notariate and notarial activities" in edition of the Law of the Republic of Belarus of January 5, 2016, Item 11 of the Regulations on the Ministry of Justice of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of October 31, 2001 No. 1605, the Ministry of Justice of the Republic of Belarus DECIDES:
1. Bring in the Instruction about procedure for the certificate of the wills and powers of attorney equated to notarially certified, approved by the resolution of the Ministry of Justice of the Republic of Belarus of February 19, 2002 No. 3 (The national register of legal acts of the Republic of Belarus, 2002, No. 34, 8/7858; 2007, No. 209, 8/16979; National legal Internet portal of the Republic of Belarus, 28.11.2014, 8/29309), following changes and amendments:
in item 4 of the word of "parents, children" shall be replaced with words "parents, adoptive parents (adopters), children including adopted (adopted)";
in Item 5:
after figures "2/1055" to add Item with words "; National legal Internet portal of the Republic of Belarus, 14.01. 2016, 2/2353";
add Item with part two of the following content:
"In case of the certificate of the will or the power of attorney officials reveal declaration of will of the testator represented and compliance of the certified will, the power of attorney to declaration of will, and also carry out legal treatment of the will, power of attorney and check compliance of contents of the draft of the will, power of attorney to requirements of the legislation.";
