About modification of the Customs code of Ukraine concerning creation of premises for new market model of natural gas
The Verkhovna Rada of Ukraine decides:
I. Article 232 of the Customs code of Ukraine (2012, Art. No. 44-48, 552) to add sheets of the Verkhovna Rada of Ukraine with parts two - the fourth the following content:
"2. Customs control and customs clearance of amounts of natural gas on transactions on substitution of natural gas (бэкхол) is performed according to the declared customs regime based on documents, stipulated in Item 5 parts one of article 335 of this Code, and also the delivery-acceptance certificate of natural gas between carriers operators of gas-transport systems of Ukraine and adjacent foreign state (separately on each Item of reception-transmission of gas) and/or the carrier operator of gas-transport system of Ukraine and the operator of gas storage containing information on amounts of natural gas on transactions of bekhol.
The procedure of customs control over amounts of natural gas is determined by transactions of bekhol by the central executive body which provides forming and realizes the state financial policy.
Transaction of bekhol is understood as transaction during which reception-transmission of natural gas by documentary registration of counter flows is performed:
the natural gas which is in adjacent gas-transport systems - carriers operators of gas-transport systems of Ukraine and adjacent foreign state on each Item of reception-transmission of gas separately without its movement by pipeline transport through customs border of Ukraine;
the natural gas which is in gas-transport system and/or in gas storages of Ukraine under customs control - carrier operator of gas-transport system of Ukraine and the operator of gas storage without its physical downloading / selection in/from gas storage.
Responsibility for declaring of amounts of natural gas on transactions of bekhol is born by the customs applicant. Bodies of the income and charges do not compensate any property claims of persons having powers of rather corresponding amounts of natural gas.
