About modification and amendments in the Law on obligatory civil liability insurance for the damage caused by vehicles No. 414-XVI of December 22, 2006

The Parliament adopts this organic law.

Art. I. – In the Law on obligatory civil liability insurance for the damage caused by vehicles No. 414-XVI of December 22, 2006 (Official monitor of the Republic of Moldova, 2007, Art. No. 32-35, 112), with subsequent changes, to make the following changes and additions:

1. In Article 2:

after the concept "Council of Bureau of the International System of Insurance "Green Card"" to add Article with concepts of the following content:

"partial damage – damage of the vehicle to such measure that recovery or replacement of the damaged components and details are possible and the size of really suffered damage does not exceed 75 percent of cost of the vehicle for date of making of incident;

complete damage – destruction of the vehicle or its damage to such measure that recovery or replacement of the damaged components and details are impossible or that the size of really suffered damage exceeds 75 percent of cost of the vehicle for date of making of incident;";

exclude the concept "original cost";

state the concept "residual cost" of the following edition:

"residual cost – the cost of the parts of the vehicle which remained unimpaired, subject to disassembly and use in case of complete damage.".

2. In Article 5:

Item b) parts (to state 2) in the following edition:

"b) participates own money in forming of external financial guarantee, stipulated in Article 35-1, during action of the requirement of Council of Bureau for maintenance of such guarantee.";

3. In Article 8:

part (to add 1) with words "which is constituted on paper and/or with use of on-line electronic technical means according to the procedure, established by regulations of supervision body.";
