About modification and amendments in the Penitentiary code of the Republic of Armenia

Article 1. Regarding the 2nd Article 114 of the Penitentiary code of the Republic of Armenia (of December 24, 2004, further - the Code) to "convict" to replace the word with words to "person condemned on imprisonment for certain term or for life".
Article 2. To add part 2 of article 114 of the Code with the new paragraph of the following content:
"The question of parole of the convict serving sentence in disciplinary battalion from serving sentence, is represented command of disciplinary battalion according to Article 115.1 of this Code.".
Article 3. To state the title of article 115 of the Code in the following edition:
"Article 115. Procedure for representation of person condemned for certain term or for life on conditionally early release, or replacement of unexpired part of punishment with softer type of punishment".
Article 4. To exclude the words "in case of contradiction to the legislation" from part 4 of article 115 of the Code.
Article 5. Add the code with Article 115.1 of the following content:
"Article 115.1. Procedure for representation on parole from serving sentence of person condemned on content in disciplinary battalion
1. After execution of the part of term of punishment established by the law the commander of disciplinary battalion surely brings in a month the petition for parole of the convict who does not have authority punishment into court.
2. Together with the petition for parole also personal record of the convict is brought into court.
3. In case of petition variation court, the petition with the same basis can be repeatedly brought into court not earlier than in six months after decision about variation.
4. Failure to carry out by the commander of disciplinary battalion of the requirement established by part of 1 this Article can be appealed judicially.".
