About modification and amendments in the Penitentiary code of the Republic of Armenia

Article 1. In Article 114 of the Penitentiary code of the Republic of Armenia (of December 24, 2004):
Part 2 to state 1) in the following edition:
"2. The procedure for discussion by organization of execution of the punishment of questions of parole of the punishment condemned from departure or replacement of unexpired part of punishment with softer type of punishment establishes the Government of the Republic of Armenia, according to Articles 115 and 116 of this Code.";
2) to add part 3 with the following content:
"3. The decision of administration of organization of execution of the punishment on submission of the petition for parole or on replacement of unexpired part of punishment with softer type of punishment to person condemned for the crimes of average weight heavy or especially heavy, or for life is approved by the independent commission on questions of parole from departure of punishment, replacement of unexpired part of punishment with softer type of punishment, the procedure for forming and which activities is established by the presidential decree of the Republic.
The commissions are included representatives of the relevant departments and other representatives of the public.".
Article 2. To state article 115 of the Code in the following edition:
"Article 115. Procedure for representation on parole from serving sentence or replacement of unexpired part of punishment with softer type of punishment
1. In case of departure of the part of term of punishment established by the law the administration of the organization performing punishment surely hears in a month question of representation of the convict who does not have authority punishments on parole from serving sentence or replacement of unexpired part of punishment with softer type of punishment.
