About modification and amendments in the Judicial code of the Republic of Armenia

Article 1. In Item 3 of part 1 of article 78 of the Judicial code of the Republic of Armenia of February 21, 2007 (further – the Code) shall be replaced with words the words "at judicial school" "in Academy of justice".
Article 2. To add article 102 of the Code with part 3 following of content:
"3. In case of suspension of powers of the scientific member of council of justice, the chairman of Court of cassation within a week addresses respectively the President of the Republic of Armenia or in National assembly for appointment of the new member of council of justice.".
Article 3. In article 103 of the Code:
Parts 2 and 3 after the words "in case" to add 1) with words "appointment of the new member".
To add 2) with parts 4-7 of the following content:
"4. The chairman of Court of cassation, within a week respectively from the date of inauguration of the Republic of Armenia or the opening day of the first session of newly elected National assembly, addresses to the appointing body for appointment of the new member of council of justice.
5. In the case provided by part 3 of this Article, the new scientific lawyer - the member of council of justice is appointed in five-day term from the date of opening of the first session of newly elected National assembly.
6. In the case provided by part 2 of this Article, the new scientific lawyer - the member of council of justice is appointed in forty-day term from the date of inauguration of the Republic of Armenia.
7. Before appointment of new scientific lawyers members of council of justice respectively the President of the Republic of Armenia and National assembly, the former members continue to hold positions.".
