About modification of the Criminal Procedure Code of Ukraine concerning accomplishment of recommendations of the European Union about accomplishment of the Action plan by Ukraine on liberalization of visa regime by the European Union for Ukraine concerning refining of competence of bodies of pre-judicial investigation

The Verkhovna Rada of Ukraine decides:

I. Bring in the Criminal Procedure Code of Ukraine (Sheets of the Verkhovna Rada of Ukraine, 2013, No. No. 9-13, of the Art. 88) the following changes:

1. In Article 216:

Figure part two in paragraph one "111, 112, 113, 114, 201, 265-1, 305, 328, 329, 330, 332, 332-1, 333, 334, 359, 422" to replace 1) with figures "110-2, 111, 112, 113, 114, 114-1, 201, 258-258-5, 265-1, 305, 328, 329, 330, 332-1, 333, 334, 359, 422";

2) in part three:

the paragraph one after figures "204" to add with figures "205, 205-1";

state paragraph two in the following edition:

"If during the investigation of the specified crimes the crimes provided by Articles 192, of 199, of 200, of 222, 222-1, 358, 366 Criminal codes of Ukraine, which are commited by person concerning which pre-judicial investigation, or other person is performed if they are connected with the crimes which are commited by person concerning which pre-judicial investigation is performed are established, they are investigated by investigators of the bodies exercising control of observance of the tax legislation";

Part the fourth to state 3) in the following edition:

"4. Investigators of bodies of the state bureau of investigations perform pre-judicial investigation of crimes:

1) made by the officials holding especially responsible position according to part one of article 9 of the Law of Ukraine "About public service", persons whose positions are carried to the first - third to categories of positions of government employees, judges and employees of law enforcement agencies, except cases when pre-judicial investigation of these crimes is referred to competence of National anti-corruption bureau of Ukraine according to part five of this Article;
