About modification of some legal acts of Ukraine concerning passing of military service in the Armed Forces of Ukraine foreigners and stateless persons

The Verkhovna Rada of Ukraine decides:

I. Make changes to the following legal acts of Ukraine:

1. Article 447 of the Criminal code of Ukraine (2001, 131) to state sheets of the Verkhovna Rada of Ukraine to Art. No. 25-26, in the following edition:

"Article 447. Nayemnichestvo

1. Recruitment, financing, material security, training of mercenaries for the purpose of use in the armed conflicts, military or violent acts directed to violent change or overthrow of the constitutional system, capture of the government, preventing of activities of public authorities or violation of territorial integrity, and also use of mercenaries in armed conflicts, military or violent acts -

are punished by imprisonment for a period of five up to ten years.

2. The same acts made by the official with use of official position -

are punished by imprisonment for a period of seven up to twelve years with confiscation of property or without that.

3. The actions provided by parts one or the second this Article, which entailed death of the person -

are punished by imprisonment for a period of ten up to fifteen years or lifelong imprisonment with confiscation of property or without that.

4. Participation of the mercenary in armed conflict, military or violent acts -

it is punished by imprisonment for a period of five up to ten years.

5. The mercenary is exempted from criminal liability for the actions provided by part four of this Article if he before criminal prosecution voluntarily stopped participation in armed conflict, military or violent acts and reported about the participation in the conflict, military or violent acts or otherwise promoted the termination or disclosure of the crimes provided by parts one - third this Article if in its actions there is no structure of other crime.
