About modification and amendments in some legal acts
The Parliament adopts this organic law.
Art. I. – In the Law on the National commission on the financial market No. 192-XIV of November 12, 1998 (repeated publication: The official monitor of the Republic of Moldova, 2007, No. 117-126 BIS), with subsequent changes to make the following changes:
1. Part (Article 22 to state 3) in the following edition:
"(3) Resolutions of the National commission on the procedure of financial improvement, about establishment of instructions and prohibitions, registration of issue of securities of issuers, suspension of action or cancellation of the license of professional participants, and also orders of the National commission become effective from the date of their edition and are told the addressee under list or the registered mail with the assurance of receipt. If the message of the act is impossible for one of the methods provided in this part, including in case of refusal the addressee from acquaintance with it, the act is considered reported from the moment of publication in the Official monitor of the Republic of Moldova and on the official web page of the National commission.".
2. State Article 23 in the following edition:
"Art. 23. – (1) Acts of the National commission are subject to check of legality in administrative court according to the procedure established by the Law on administrative court, and requirements of this law. Provisions of other laws can be applied in cases of contest of acts of the National commission only in that measure in what they do not contradict regulations, the established this law.
(2) the Requirement about suspension of execution of acts of the National commission can be declared in administrative court only after contest of these acts in the National commission within 30 days from the date of the message of the reply of the National commission on the provisional statement concerning these acts or after the expiration of consideration of the provisional statement. 30-day term is not applied to acts of normative nature.
