About modification of the Criminal code of Ukraine concerning excess by the military official of the power or office powers

The Verkhovna Rada of Ukraine decides:

1. The criminal code of Ukraine (2001, Art. No. 25-26, 131) to add sheets of the Verkhovna Rada of Ukraine with Article 426-1 of the following content:

"Article 426-1. Excess by the military official of the power or office powers

1. Excess by the military official of the power or office powers, that is intentional making of the actions which are obviously going beyond the rights or powers granted to this person except provided by part two of this Article if these actions did essential harm, -

it is punished by restriction of freedom for a period of two up to five years or imprisonment for the same term.

2. Application of non-statutory corrective actions concerning the subordinate or exceeding of the disciplinary power if these actions did essential harm, and also use of violence to the subordinate -

are punished by imprisonment for a period of three up to seven years.

3. The acts provided by part two of this Article, made using weapon and also the acts provided by parts one or the second this Article if they entailed heavy effects, -

are punished by imprisonment for a period of five up to nine years.

4. The acts provided by parts one, the second or third this Article, made in the conditions of the special period except warlike situation, -

are punished by imprisonment for a period of seven up to ten years.

5. The acts provided by parts one, the second or third this Article, made in the conditions of warlike situation or in fighting situation -

are punished by imprisonment for a period of eight up to twelve years".

2. This Law becomes effective from the date of, its publication following behind day.
